The <br />Building Code does not perllrit an exterior sLair to be located in an area <br />r",here fire protection of openings is required (Section 3305-n, UBC). In <br />the case of this building, fire protection of openings is required at 20' <br />from a propertv 1ine, So in this case, a 20' yard is required from the stair <br />to the property line, <br />At some point in the design of thls project a decision r,ras made (witho'ut the <br />approval of this department) to install an open stair in the rear and to <br />secure an easement to provide a yard to eliminate the required fire Protec-tion. However, such a solution is not acceptable to this departnent for the <br />fol loving reasons: <br />1. The proposed easement is not of sufficient <br />2. An easement can be terminated at any time <br />enforcing <br />r,,idth. <br />by the parties involved. <br />nor keeping track of this3 <br />4 <br />5 <br />There is no effective nethod of <br />or any other private easement. <br />It puts the city in fhe position of restricting construction on <br />adjacent property for the benefj.t of another property holder. <br />The Bullding Code requires that a <br />as the buildin8. <br />yard be situated on the same 1ot <br />There are two alternatives left for the stairs; either enclose <br />them inside the existinS bullding.
