<br />7. THE CONTRACTOR SHALL TAKE FIELD MEASUREMENTS AND VERIFY FIELD CONDITIONS AND SHALL CAREFULLY COMPARE
<br />SUCH FIELD MEASUREMENTS AND CONDITIONS AND OTHER INFORMATION KNOWN TO THE CONTRACTOR WITH THE
<br />CONTRACT DOCUMENTS BEFORE COMMENCING ACTIVITIES. ERRORS, INCONSISTENCIES OR OMISSIONS DISCOVERED
<br />SHALL BE REPORTED TO THE ARCHITECT/ENGINEER AT ONCE.
<br />8. THE CONTRACTOR WARRANTS TO THE OWNER AND ARCHITECT/ENGINEER THAT MATERIALS AND EQUIPMENT
<br /> FURNISHED UNDER THE CONTRACT WILL BE OF GOOD QUALITY AND NEW UNLESS OTHERWISE REQUIRED OR PERMITTED BY
<br />THE CONTRACT DOCUMENTS, THAT THE WORK WILL BE FREE FROM DEFECTS NOT INHERENT IN THE QUALITY
<br />REQUIRED OR PERMITTED, AND THAT THE WORK WILL CONFORM WITH THE REQUIREMENTS OF THE CONTRACT DOCUMENTS.
<br />WORK NOT CONFORMING TO THESE REQUIREMENTS, INCLUDING SUBSTITUTIONS NOT PROPERLY APPROVED AND
<br />AUTHORIZED, MAY BE CONSIDERED DEFECTIVE. THE CONTRACTOR'S WARRANTY EXCLUDES REMEDY FOR DAMAGE OR
<br />DEFECT CAUSED BY ABUSE, MODIFICATIONS NOT EXECUTED BY THE CONTRACTOR, IMPROPER OPERATION, OR

<br />9. THE CONTRACTOR SHALL EMPLOY A COMPETENT SUPERINTENDENT AND NECESSARY ASSISTANTS WHO SHALL BE IN
<br />ATTENDANCE AT THE PROJECT SITE DURING PERFORMANCE OF THE WORK. THE SUPERINTENDENT SHALL REPRESENT THE
<br />CONTRACTOR, AND COMMUNICATIONS GIVEN TO THE SUPERINTENDENT SHALL BE AS BINDING AS IF GIVEN TO THE
<br />CONTRACTOR. IMPORTANT COMMUNICATIONS SHALL BE CONFIRMED IN WRITING. OTHER COMMUNICATIONS SHALL BE
<br />SIMILARLY CONFIRMED ON WRITTEN REQUEST IN EACH CASE.
<br />10. CONTRACTORS AGREES THAT HE SHALL ASSUME SOLE AND COMPLETE RESPONSIBILITY FOR JOB SITE CONDITIONS DURING
<br /> THE COURSE OF CONSTRUCTION OF THIS PROJECT, INCLUDING SAFETY OF ALL PERSONS AND PROPERTY; THAT THIS
<br />REQUIREMENT SHALL APPLY CONTINUOUSLY AND NOTE BE LIMITED TO NORMAL WORKING HOURS; AND THAT THE
<br />CONTRACTOR SHALL DEFEND, INDEMNIFY AND HOLD THE OWNER AND THE DESIGNER HARMLESS FROM ANY AND ALL
<br />LIABILITY, REAL OR ALLEGED, IN CONNECTION WITH THE PERFORMANCE OF WORK ON THIS PROJECT.
<br />11. CONTRACTOR SHALL CONTACT UNDERGROUND SERVICE ALERT 1-800-422-4133, 48 HOURS IN ADVANCE OF COMMENCEMENT
<br /> OF CONSTRUCTION, FOR EXISTING UTILITY LOCATIONS. ONLY WHEN WORK IS DONE OFF SITE IN THE PUBLIC
<br />RIGHT-OF-WAY.
<br />12. THE GROUND IMMEDIATELY ADJACENT TO THE FOUNDATION SHALL BE SLOPED AWAY FROM THE BUILDING AT A SLOPE OF NOT
