Round 1 Bowling and Amusement 12/09/2024 Paradigm Design <br />Main Place Mall Expansion Grand Rapids, MI <br />Santa Ana, California <br />Project #2309147GR <br />GENERAL AND SUPPLEMENTARY CONDITIONS OF THE CONTRACT 00 7000 - 3 <br />ed. 2023-09-22 <br />9.8.5.1 The payment shall be sufficient to increase the total payment to 95% of the contract sum, less <br />such amount the Architect shall determine for incomplete work and unsettled claims. <br />ADD TO ARTICLE 10, PROTECTION OF PERSONS AND PROPERTY, <br />AS FOLLOWS: <br />10.1.1 Contractor is responsible to provide an overview of its safety program and requirements of <br />the Landlords Corporate Safety Program, including any policy statement, description of its <br />methods of implementing and enforcing safety measures, and its procedures for <br />identifying/controlling hazards. Prior to first application for payment, Contractor shall <br />provide: <br />.1 A written inventory of all hazardous materials it will have on the Project Site. <br />.2 A material Safety Data Sheet (MSDS) for each of the hazardous materials. <br />.3 A statement on its letterhead confirming that its workers have received proper <br />training in the handling of those hazardous materials. <br />ADD TO ARTICLE 11, INSURANCE AND BONDS, AS FOLLOWS: <br />11.1.1.1 Contractor shall in no event be liable to Owner and in no event shall the Owner be liable to <br />Contractor, separate Contractors or Subcontractor for any extended coverage perils in <br />connection with this contract whether during or after completion of this contract. Contractor <br />shall include in contracts with his separate Contractors or Subcontractors a similar waiver of <br />recovery rights by the separate Contractors and/or Subcontractors against Owner and <br />Contractor. <br />11.1.1.2 The insurance required by subparagraph 11.1.1 shall include all major divisions of coverage <br />and shall be on a comprehensive general basis including premises and operations, Owner’s and <br />Contractor’s protective products and completed operations, and owned, non-owned, and hired <br />motor vehicles. Such insurance shall be written for not less than any limits of liability required <br />by law or those set forth below, whichever is greater, on an occurrence coverage basis. <br />CONTRACTOR INSURANCE REQUIREMENTS: <br />1.Worker’s Compensation: <br />a.State Statutory Limits <br />b.Applicable Federal Statutory Limits <br />c.Employer’s Liability: <br />i.Bodily Injury by Accident $1,000,000 per occurrence <br />2.Comprehensive General Liability written on an occurrence basis (including Premises <br />Operations; Independent Contractor’s protective; Products and Completed Operations; <br />Broad Form Property Damage): <br />a.General Aggregate $4,000,000 <br />b.Personal Injury (per occurrence)$4,000,000 <br />c.Property Damage/Completed Operations $2,000,000 <br />d.Property Damage Liability Insurance will provide Waiver of X, C and U <br />exclusions.
