APPEALS BOARD OF THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence
public hearing, this Board finds
the following findings of fact:
(a) The actual occupant load of Appellants' real
property is less than one hundred (I00) persons;
(b) Hourly occupancy calculations made by APPellants
and submitted to the Board, for the months of January' 1982,
February, 1982, March, L982 and April, 1982, show that the
average number of people (including customers and employees)
per h5ur in Appellintsr store during January, 1982, was 8'45
petsons; 9.32 persons during February, 1982; 9.46 persons
huring March, 1982; and 9.55 persons during April, 1982.
(c) Further calculations performed by ApPellants
and submitted to the Board show that for the five (5) day
period of May I2-L6, 1982, the average hourly occupancy in
lppellants' itore during said five (5) day period was 8'57
persons and that the highest actual occupancy, at any one
time during said five (5) day period, was l0 Persons.
(d) As further findings of fact in support of its
decision, this Board adopts, and hereby incorporates by
reference as if fulty set forth at this point, the May 20,
1982 report submitted to the Board by Appellants' counsel,

period of May L2-16, 1982, the average hourly occupancy in
Appellants' store during said five (5) day period was 8.57
persons and that the highest actual occupancy, at any one
time during said five (5) day period, was 10 persons.
(d) As further findings of fact in support of its
decision, this Board adoPts, and hereby incorPorates by
reference as if fuI1y set forth at this Point, the May 20,
1982 report submitted to the Board by Appellants' counsel,

APPEAL BY ALAN KUNSKI , EUGENE EPHRAT ET AL
Background
An engineering field survey of the building at-501 South Main was
compl6ted as i part of a comprehensive study of all unreinforced
masonry buildinqs in Santa Ana as required by the Earthquake Hazard
Reduction 0rdinince (Article XI, Chadter I, SMC). As a result of
this survey the building was determined to be subiect to the ordi-
nance.
The ordinance requires that the occupant capacity be calculated
usino floor area as well as the current use of the building based
on Tible 33A, uBC (Attachment #1). Our initial engineering field
survev of th; buildinq estimated an occupant capacity greater than
170 (l\ttachment #2). -Based on the occupant capacity the building
was classified as Class II (high risk) building (Attachment #3).
0n March 30, Mr. Steponovich representing Mr. Kunski submitted a
dimensioned-sketch o? the building with a request for reclassifi-
cation to Class III (medium risk), (Attachments #4 & #5). The
request was based on a belief that the occupant capacity of the
builaing is less than 100. An analysis of the occupant capacity -
was mad6 on April 1, 1981 using the djmensions and descriptions of
use submitted by the owner. The submitted sketch contained an
area indicated io be warehouse-showroom. For the purpose of de-
termining the occupant capacity by this departfient, this area was
assigned-the Iower' use clissification of warehouse. If the analysis
had iesulted in the necessity to reclassify the building, a field
inspection would have been completed to confirm dimens'ions and use.
tn ttris case our analysis resuited in a confjrmation of our previous
iinainq tlat the building was properly classified as Class II (high
risk),-(Attachment #6). -The owner and his attorney were adv'ised of
our decision by the letter dated Aprit 17, 1981 (Attachment #7).
A field inspection of the subject building was completed on May 28'
1981 in ordbr to verify the data submitted by the owner and the use
of the various areas oi the building. one of the findings of this
investigation was that an area previously calculated as warehouse
was det6rmined to be a showroom. The resul ting occupant capacity
for the building is 133, (Attachment #8). The correct risk classi-
fication is Clais II (high risk).

This letter is in response to your request for

The Ordinance directs that the occupant load is to be deter-
mined by reference to Chapter 33 of the Uniform Building Code(Sec!ion 8-2002(b), Santa Ana ttlunicipal Code). t{hen the oc-
cupant load is not given in Table 33-A for a pdrticular
building use, it is determined by the building official ,
based on the standard given for the occupancy which it rnos t
nearly resembles (Section 3301(d), Unlform BuiTding Code).
In reference to furniture sales occupancles in buildings sub-
Ject to the Seismic Ordinance, the Director has deteroined
that. the use category that tt mostly resernbles is one hundred(100) square feet per occupant.

relayed to us irr our telephone conversation of Wednesday, I"larch 18, 1981.
Our client is in the process of preparing the necessary sketches to request
a reclass if ication of the subject property, pursuant to the referenced
ordinance, fron a "high risk bui.lding" to a "nedirln risk building" ' Naturally,
as soon as those drawings are cofiplete they will be forwarded to you for
cons iderat ion thereon.
'Ihis letter will also confirm our conversation with regard to llr ' Grantrs
letter of Febrr.rary 24, 1981, wherein it stated that our client originally
received notification on Septenber 23, 1980. As we discussed, that date is
j.ncorrect and, to be accurate, should read Novenber 12, 1980. With that
correction, our client's ti-ne period for appeal will expire on l"lay 11, 1981
and his t irE period for the analysis required by the ordinance would expire
on August 9, f981. Naturally, if the reclass if icat ion referenced were
granted, those dates would have no significance, as a new notice would be
required sonEtime later this year.

As there are 6,386 square feet in this area, that breaks down to
a total of 25.5 people. However, if only showroom occupaary load
was used, that would be 31.9 people;
If the total area in the buildhg dedicated to storage is 3,964
square feet and, usilg 300 square feet per person, that is 13.2
people ;
6 Us ing all of the calculations above, the occupancy load of the
building is 75 people and, if the showroon/storage calculation were
refused and a shouroom calculation used in its place, the load would
j.ncrease to 81 .4 people. In any event, the occupancy load is greater
than 20 but less than 100, and thereby nEets the qualifications for
a "medium risk building".
In light of all of the above, and the attached drawing in support thereof,
we ask for a reclass if icat ion of the building in question. Cons iclering
the fact that our client has already been notified as a 'high risk
buildi-ng" and the fast approaching expiration of his tj:ne for the structural
analysis, we would ask for your expeditious attention to this request.
