The accompanying Final Notice and order ls the last notice you will
receive before your building at the subject address is posted with
Lrarning signs indicating that it is a dangerous building. The
building cannot be occupied beyond the date indicated in the Final
Notice and Order.
The only exception to the order vould be for contractors effecting
repairs, under permit, to bring the structure into complj.ance vith
the Seismic Ordinance.

submit plans for the seismic vork, obtain permits, and complete the

Section 8-2004(e) and Secrlon 701(c) cf the Uniform Code for thc AbatemenEof Dangerous Buildings.
YOLI ARE HEREBY NOTIFIED thar rhe above-described structure has been deemedto constitute a dangerous building due to non-compliance uith Article XI(consistlng of Sections 8-2000 to 8-2007) of Chapter 8 of the SAMC entir.led
"Earthquake Hazard Reduction in Existing Buildings". Article XI of Chapter 8of the SAMC is comrnonly known as the City's Selsmic Safety ordinance.
Pursuant to SAMC Section 8-2004(b), the deadline for obraining permirs forful1 seismi.c repair under the provisions of the City's Seismic Safety
Ordinance was July 29, 7984.
YoU ARE THEREFORE FURTHER ADVISED rhat pursuanr ro Secrion 701(c) of the
Uni.form Code for the Abatement of Dangerous Buildings, a copy of vhich isattached hereto as Exhibit "A" and incorporated herein by reference, that1f, by October 10, 1984, required permits for full sej.smic repair have not
been obtained, the City of Santq Ana intends to enforce its Seismic Safety
Ordinance in accordance with any or all of the provj-sions of Section 701(c).
It is suggested that you notify each of your tenants of the contents of thisNotice so that they can take appropriate action before the deadline.

First of all, we do not think the new building will be ready for
occupancy by thar date. The problern is thaE major rehab canno t be
done to existing bui.lding during our occupancy. So regardless of
r.,heEher the existing building is rehabilitated or not, it cannot be
done whi-le r{,e are in business in the building. We therefore ask that
we be permitted to occupy t.he building up to tr.Io rnonths beyond the
July 29th date. Thls will a 11ow us to complete our !enant
improvement s so that we can move. After we have vacated the exlsting
building, the owner can then comply by r ehabil i tat ing, abandoning'
demollshing, or selling it.

In response to your letter to me dated t4ay 29, 1984, identified as your
#515-84, wherein you requested an extension of occupancy for the Dr.
Beauchamp office's at 410 North Main Street, Santa Ana, I submit to you

Under the City'd,Seismlc Safety OrCinance, we have no authority to
allow the tenant \f the Class III (Medium Risk) buildinS at 410 North
Main Street to occ\.rpy rhe building beyond the July 29, 1984 dead1lne,
unfess he is ln conformance uith said ordinance. As I told you on the
phone last week, the only way he can remain within conformance of the
code is to obtai.n building permits for full seismic rehabilitation prj.or
to the July 29, 7981+ deadline.
The ovner of the subject building has previously requested, within the
time limitations, a lower classj.fication of the building. However,
based upon the use of Lhe building the occuPancy 1eve1 of the use could
not be conputed low enough to qualify it for Low Risk status. This
leaves us with the seismic rehabilitation buildlng permit as the only
available and 1egal option. t have discussed this matter with the bui.ldin8
ovner and explained the entire situation.
I am sorry I cannot accommodate your request. You should be aware that
the property owner has had over nine rnonths, since the first notice uas
mailed, to determine how to conply with the Seismic 0rdinance. I vould
recommend that the owner take appropriate action to obtain building permits
as soon as is possible.

Dear Mr. Freeland:
We have entered into an agreement with the Dental Finance Company,
commonly known as Dr. Beauchamp, to provide office space in our 500
building on North Main.
Under the City's schedule, he is to move out of his present building at
the end of July. There are a number of problems connected with this
deadline. First of all, we do not think we can have his new building
ready for occupancy by that date. Another problem is that ma.ior rehab
work cannot be done to that existing building during his occupancy.
So regardless of whether the existing building is rehabed or not, it
cannot be done while he is in business in the building. We, therefore,
ask that he be permitted to occupy the building up to 2 months beyond
the end of July, This will allow us to complete our tenant improve-
ments so that he can move. After he has vacated his existing building,
the owner can either abandon it, rehabilitate it, or demolish it. ln any
case, none of the above should be done before he moves out. He has
asked me to get a commitment from the City on the matter, Please
advise me in writing on a commitment from the City on this matter.
