<br />1. THIS PROJECT AND ALL WORK ASSOCIATED WITH THE PROJECT
<br />SHALL CONFORM TO STATE AND LOCAL CODE JURISDICTIONS.
<br />2. THE TERM DESIGNER AS USED IN THESE DOCUMENTS SHALL REFER
<br />TO BN DESIGN BUILD INC.
<br />3. THE DESIGNER SHALL NOT HAVE CONTROL OR CHARGE OF AND
<br />SHALL NOT BE RESPONSIBLE FOR MEANS, METHODS, TECHNIQUES,
<br />SEQUENCE ON PROCEDURE, OR FOR SAFETY PRECAUTIONS AND
<br />PROGRAMS IN CONNECTION WITH THE WORK, ALL WHICH SHALL BE
<br />THE SOLE RESPONSIBILITY OF THE CONTRACTOR.
<br />4. SHORING, TEMPORARY SUPPORTS, AND SAFETY OF ERECTION
<br />BRACING DURING DEMOLITION AND / OR CONSTRUCTION IS THE SOLE
<br />RESPONSIBILITY OF THE CONTRACTOR AND HAS NOT BEEN
<br />CONSIDERED BY THE STRUCTURAL ENGINEER OR THE DESIGNER.
<br />5. ALL WORK NOTED "N.I.C." OR "NOT IN CONTRACT" IS TO BE
<br />ACCOMPLISHED BY A CONTRACTOR OTHER THAN THE GENERAL
<br />CONTRACTOR AND IS NOT TO BE PART OF THE CONSTRUCTION
<br />AGREEMENT. THE GENERAL CONTRACTOR SHALL COORDINATE WITH
<br />"OTHER"CONTRACTORS PER REQUIREMENTS ESTABLISHED BY THE
<br />OWNER.
<br />6. THE GENERAL CONTRACTOR AND ALL SUB CONTRACTORS ARE
<br />RESPONSIBLE FOR EXAMINING CONTRACT DOCUMENTS, FIELD
<br />CONDITIONS, AND CONFIRMING THAT WORK IS BUILDABLE AS SHOWN
<br />BEFORE PROCEEDING WITH CONSTRUCTION. IF THERE ARE ANY
<br />QUESTIONS REGARDING THESE OR OTHER COORDINATION ITEMS, THE
<br />CONTRACTOR IS RESPONSIBLE FOR OBTAINING CLARIFICATION
<br />BEFORE PROCEEDING WITH WORK IN QUESTIONS OR RELATED WORK.
<br />7. CONTRACTOR SHALL MAINTAIN RECORD DOCUMENTS OF
<br />CONSTRUCTION CHANGES (AS-BUILT DRAWINGS) AND SHALL PROVIDE
<br />SAID DOCUMENTATION TO THE OWNER & DESIGNER UPON
<br />COMPLETION OF CONSTRUCTION.
<br />8. THE GENERAL CONTRACTOR IS SOLELY RESPONSIBLE TO
<br />COORDINATE WITH ALL SUB CONTRACTORS PER REQUIREMENTS
<br />ESTABLISHED BY THE OWNER, WHICH ARE UNDER SEPARATE
<br />CONTRACT WITH THE OWNER.
<br />9. THE STRUCTURAL, ELECTRICAL, MECHANICAL, & PLUMBING & OTHER
<br />DRAWINGS AND JOB SPECIFICATIONS ARE SUPPLEMENTARY TO THE
<br />DESIGNERURAL CONSTRUCTION DRAWINGS. ANY DISCREPANCY
<br />BETWEEN THESE DOCUMENTS SHALL BE IMMEDIATELY BRING TO THE
<br />ATTENTION OF THE DESIGNER FOR CLARIFICATION.
<br />10. THEN INTENT OF DRAWINGS AND SPECIFICATIONS IS TO INCLUDE
<br />ALL LABOR, MATERIALS & SERVICES NECESSARY FOR THE
<br />COMPLETION OF ALL WORK SHOWN, DESCRIBED, OR REASONABLY
<br />IMPLIED, BUT NOT LIMITED TO THAT EXPLICITLY INDICATED ON THE
<br />CONTRACT DOCUMENTS.
<br />11. INSTALL ALL MANUFACTURED ITEMS, MATERIALS, AND EQUIPMENT
<br />IN STRICT ACCORDANCE WITH THE MANUFACTURER
<br />RECOMMENDATIONS, UNLESS NOTED OTHERWISE.
<br />12. ANY WORK INSTALLED IN CONFLICT WITH THE CONSTRUCTION
<br />DRAWINGS, WITHOUT THE PRIOR APPROVAL OF THE OWNER AND THE
<br />DESIGNER SHALL BE CORRECTED AT THE CONTRACTOR'S EXPENSE.
<br />13. THE GENERAL CONTRACTOR SHALL NOTIFY THE DESIGNER
<br />IMMEDIATELY OF ANY SPECIFIED MATERIALS OR EQUIPMENT WHICH
<br />ARE EITHER UNAVAILABLE OR THAT WILL CAUSE A DELAY IN THE
<br />CONSTRUCTION COMPLETION SCHEDULE. THE CONTRACTOR SHALL
<br />SUBMIT CONFIRMATIONS OF DELIVERY DATES FOR ORDERS OF
<br />MATERIALS AND EQUIPMENT HAVING LONG LEAD TIMES.
<br />14. ALL REQUESTS FOR SUBSTITUTIONS OF ITEMS SHALL BE
<br />SUBMITTED IN WRITING TO THE DESIGNER. SUBSTITUTIONS SHALL BE
<br />OF EQUAL QUALITY.
<br />15. UNLESS OTHERWISE NOTED IN THE CONTRACT DOCUMENTS, THE
<br />CONTRACTOR SHALL SUBMIT 3 SETS OF SHOP DRAWINGS.
<br />FABRICATION SHALL NOT BEGIN UNTIL AFTER RECEIVING THE
<br />DESIGNER'S OR ENGINEER'S APPROVAL.
<br />16. THE DESIGNER'S REVIEW OF SHOP DRAWINGS SHALL NOT RELIEVE
<br />THE GENERAL CONTRACTOR OR SUBCONTRACTOR FROM
<br />RESPONSIBILITY FOR DEVIATIONS FROM THE DRAWINGS AND
<br />SPECIFICATIONS UNLESS HE HAS, IN WRITING, AND BROUGHT TO THE
<br />ATTENTION OF THE DESIGNER SUCH DEVIATIONS AT THE TIME OF THE
<br />SUBMISSION, NOR SHALL IT RELIEVE HIM FROM RESPONSIBILITY FOR
<br />ERRORS OF ANY SORT IN THE SHOP DRAWINGS.
<br />17. THE GENERAL CONTRACTOR SHALL BE RESPONSIBLE FOR
<br />OBTAINING ALL REQUIRED BUILDING PERMITS PRIOR TO STARTING
<br />CONSTRUCTION.
<br />18. PRIOR TO THE ISSUANCE OF A BUILDING PERMIT, THE APPLICANT
<br />SHALL HAVE EVIDENCE OF CURRENT WORKMAN'S COMPENSATION
<br />INSURANCE COVERAGE ON FILE WITH THE STATE LABOR CODES.
<br />19. CONTRACTOR PROVIDE CONTINUOUS INSPECTIONS AS SET FORTH
<br />IN LOCAL AND STATE CODES AND PER THE CONTRACT DOCUMENTS AS
<br />NEEDED.
<br />20. THE CONTRACTOR, AT HIS OWN EXPENSE, SHALL KEEP THE
<br />PROJECT AND SURROUNDING AREAS FREE FROM TRASH AND DEBRIS.
<br />THE WORK SHALL BE IN CONFORMANCE WITH THE AIR & WATER
<br />POLLUTION CONTROL STANDARDS AND REGULATIONS OF THE STATE
<br />DEPARTMENT OF HEALTH.
<br />21. CONSTRUCTION WASTE & DEBRIS SHALL BE DEPOSITED AT AN
<br />APPROPRIATE SITE.
<br />
<br />22. THE CONTRACTOR SHALL BE RESPONSIBLE FOR THE GENERAL
<br />CLEANING OF THE JOB AFTER COMPLETION.
<br />23. THE CONTRACTOR SHALL PROVIDE PEDESTRIAN PROTECTION,
<br />WHERE REQUIRED PER STATE AND LOCAL CODES.
<br />24. IF TRENCHES OR EXCAVATIONS 5'-0" OR MORE IN DEPTH ARE
<br />REQUIRE, OBTAIN A BUILDING OR GRADING PERMIT.
<br />25. NO HAZARDOUS MATERIALS SHALL BE USED OR STORED WITHIN
<br />THE BUILDING WHICH DOES NOT COMPLY WITH THE LOCAL FIRE
<br />AUTHORITY AND STATE & COUNTY REQUIREMENTS.
<br />26. THE CONTRACTOR IS RESPONSIBLE FOR BLOCKING OFF SUPPLY &
<br />RETURN AIR GRILLES & DUCTS TO KEEP DUST FROM ENTERING INTO
<br />THE BUILDING DISTRIBUTION SYSTEMS.
<br />27. ALL CONSTRUCTION & DEMOLITION SHALL BE DONE IN
<br />ACCORDANCE WITH LOCAL & STATE CODES.
<br />28. UNLESS OTHERWISE NOTED OR INDICATED, ALL DIMENSIONS ON
<br />THESE DOCUMENTS SHALL BE TO FACE OF CURB, FACE OF

<br />ACCESS TO FIRE SPRINKLER, MECHANICAL, PLUMBING & ELECTRICAL
<br />WORK. CONTRACTOR SHALL SUBMIT A PLAN OF ALL PROPOSED
<br />ACCESS PANEL TO THE DESIGNER FOR APPROVAL.
<br />33. ALL PENETRATIONS AT RATED CONSTRUCTION SHALL BE
<br />PROTECTED TO MAINTAIN RATING.
<br />34. INTERIOR WALLS & CEILINGS SHALL BE INSTALLED IN ACCORDANCE
<br />TO STATE & LOCAL CODES, INCLUDING REQUIREMENTS FOR FLAME
<br />SPREAD AND SMOKE DENSITY RATINGS FOR FINISH MATERIALS.
<br />35. ALL NEW CONSTRUCTION MATERIALS SHALL BE 100% ASBESTOS
<br />FREE.
<br />36. ALL INSPECTIONS SHALL BE CALLED FOR AND PASSED BEFORE ANY
<br />WORK CONTINUES TO THE NEXT PHASE.
<br />37. MANDATORY SPECIAL INSPECTIONS PER THE REQUIREMENTS OF
