The contract documents Include the working drawings, specifications, addenda, modifications, and the conditions of the construction contract 2. The contract documents are the instruments of service and shall remain the property of the Architect whether the project for which they are prepared is executed or not The contract documents are not to be used by the landlord or tenant for other projects or extensions to the project nor are they to be modified in any manner whatsoever except by agreement in writing and with appropriate compensation to the Architect 3. The work will conform with the requirements of the Uniform Building Code, 2001 Edition, and the requirements of 41 other agancies having jurisdiction. 4. "Architece'means RUTH HASELL AIA ARCHITECT. S. "Landlord' or "Base Building 0" ter" means NA. 6. "Tenane,or"Ownee'means RICHARD CHIARINI. 7. "Furnish" means supply only, for 4)thers to put in place. 8. Contractor to verify dimensions and orientation. 11. "Typical" means identical for coiididons noted. 12- Do not scale drawings, dimensions govem. Verify dimensions with field conditions and drawings. If discrepancies are discovered between field conditions and drawings, or between individilal drawings, contact the Architect for resolution before proceeding. 13. Horizontal dimensions indicated are to/from finished face of construction, except as noted. 14. Ver-tilcal dimensions are from tol> of floor stab, except where noted to be from above finished floor, (AFF). 15. Dimensions are not adjustable vdthout approval of Architect unless noted * or 16. All work shall be erected and installed plumb, level, square and true, and in proper alignment 17. Cut and fit components for altei-ation of existing work and installation of new work. Patch disturbed area to match adjacent materials and finishes. I & Patch and repair all fireproofing damaged or removed during performance of new work. Fireproof now penetrations required by the work and existing penetrations In exposed plenum areas. 19. Coordinate and provide approp1ate structural blocking/backing and reinforcing in partitions behind all wall mounted items. All concealed wood to be fire treated where required. 20. Make all necessary provisions for items to be furnished or Installed by Owner. Provide protection for these provisions until completion of the project General Contractor to coordinate NIC items with appropriate trades. 21. General Contractor shall be responsible for checking contract documents, field conditions and dimensions for accuracy and confirniing that work is as shown before proceeding with construction. Clarifications regarding any conflicts shall be resolved prior to related work being started. 22. General Contractor & sub -Contractors shall coordinate the layout and exact location of all partitions, doors, electrical/telephone outlets and light switches with Architect Architect to verify in field before Proceeding with construction. 23. Mechanical, electrical, plumbing & fire protection systems, shop drawings and layouts shall be submitted as soon as possible, afteraward of contract, to the Architect allowing ten (10) working days for review. No construction sF,all proceed until the approval of these submittals. All the above trades need to be submitted to the Architect at the same time. 24. All glass and glazing used in this project shall conform to requirements of Chapter 24, 2001 UBC and all Federal Requirements. 25. Submit required shop drawings and samples for all trades as soon as possible to the Architect before proceeding with the work 26. Contractor shall provide manufacturer's specifications, installation instructions, shop drawings and samples for review and approval prior to ordering or proceeding with the work 27. Contractor to follow manufacturer's recommended specifications and installation procedures. If these are contrary to the constniction documents, Contractor shall notify Architect, in writing immediately, to resolve discrepancies prior to proceeding. 28. Contractor to exercise care and precaution during construction of the work to minimize disturbances to adjacent structures and their occupants, property, public thoroughfares, etc. Contractor shall be responsible for mfety during construction procedures. 29. Within, five (5) days from contract date, Contractor to prepare & submit an estimated progress schedule, for the work with sub -schedules of related activities which may affect the progress- 30. All work shall comply with the applicable codes, amendments, rules, regulations, ordinances, laws, orders, approvals,etc., that are required by public authorities. I Stockpiles of soil shall be properly contained to minimize sediment transport from the site to streets, drainage facilities or adjacent properties via runoff, vehicle tacking, or wind. 3. Appropriate BWs for construction -related materials, wastes, spills shall be implemented to minimize transport from the site to streets, drainage facilities, or adjoining properties by wind or runoff. 4. Runoff from equipment and vehicle washing shall be contained at construction sites unless treated to reduce or remove sediment and other pollutants. 5. All construction contractor and subcontractor personnel are to be made aware or the required best management practices and good housekeeping measures for the project site and any associated construction staging arm. 6. At the end of each day of construction activity all construction debris and waste materials shall be collected and properly disposed In trash or recycle bins. 7. Construction sites shall be maintained Pt such a condition that an anticipated storm does not carry wastes or pollutants off the site. Discharges of material other than stormveAer only when necessary for performance and completion of construction practices and where they do not cause or tonteibute to a violation of any water quaky standard; cause or threaten to cause pollution, contamination, or nuisance-, or contain a hazardous substance in a quantity reportable under Federal Regulations 40 CFR Parts 117 AND 302. 32. In the event of conflict between data shown on drawings and data shown in the specifications, the specifications shall govern. Dimensions noted on drawings shall take precedence over scaled dimensions. Detail drawings take precedence over drawings of smaller scale. Should the Contractor at any time discover an error in a drawing or specifications, or a discrepancy or variation between dimensions on drawings and measurements at site, or lack of dimensions or other information he/she shall report at once to the Architect for clarification and shall not proceed with the work affected until clarification has been made. 33. Only new items of recent manufacturer, of standard quality, free from defects, will be permitted on the work. Rejected items shall be removed immediately from the work and replaced with items of the quality specified. Failure to remove rejected materials and equipment shall not relieve the Contractor from the responsibility for quality and character of items used nor from any other obligation imposed on him by the contract. 34. The finished work shall be firm, well anchored, in true alignment plumb, level, with smooth, clean, uniform appearance without waves, distortions, holes, marks, cracks, stains, or discoloration. jointings shall be tight fitting, neat and well scribed. The finish work shall not have exposed unsie* anchors or fasteners and shall not present hazardous, unsafe comers. All work shall have the provision for expansion/contraction, and shrinkage as necessary to prevent cracks, buckling and warping due to temperature and humidity conditions. 3S. Attachments, connections, or fastening of any nature are to be properly and permanently secured in conformance with best practice and the Contractor is responsible for improving them according to these conditions. The drawings show only special conditions to assist the Contractor. they do not illustrate every such condition and detail. 3& The Contractor is responsible for verifying the dimensions and elevations at the site, The Contractor and Sub -contractor shall coordinate the layout and exact location of all partitioning, doors, electrical/telephone outlets, light switches, and thermostats with the Architect In the field before proceeding with construction. 37. The Contractor shall continuously check Architectural and structural clearances for accessibility of equipment and mechanical & electrical systems. Contractor shall verify that no conflict exists in locations of mechanical, telephone, electrical, lighting plumbing, and sprinkler equipment (to include all piping, duct work and conduit) and that all required clearances for installation and maintenance of above equipment are provided. Contractor shall notify Architect of any conflicts regarding the above systems before proceeding with the work No allowances of any kind will be made for the Contractor's negligence to note unforeseen means of installing equipment into position inside structure. What elements are to be exposed or concealed AS be determined and reviewed with Architect prior to construction proceeding. 38. No work defective in construction or quality, or deficient In any requirements of drawings and specifications will be acceptable In consequence of Owner's or Architect's failure to discover or to point out defects or deficiencies during construction, nor will presence of inspectors on work site relieve Contractor from responsibility for securing quality and progress of work as required by contract. Defective work revealed within the time required by guarantees shall be replaced by work conforming with the intent of contract No payment whether partial or final shall be construed as an acceptance of defective work or Improper materials. 39. Materials and workmanship specified by reference to number, symbol tide of a specification such as commercial standards, federal specifications, trade association standard, or other similar standard, shall comply with requirements in latest edition or revision thereof and with any amendment or supplement thereto in effect on date of origin on the projects contract documents. Such standard, except as modified herein, shall have full force and effect as though printed in contract documents. 40. Contractor shall waive "common practice" and "common usage" as construction criteria wherever details and contract documents or governing codes, ordinances, etc., require greater quantity or better quality than common practice or common usage would require. 41. Contractor shall order and schedule delivery of materials in ample time to avoid delays in construction. If an item Is found to be unavailable, Contractor shall notify Architect immediately to allow Architect reasonable time to select a reasonable substitute. 42, If at any time before commencement of work, or during process thereof, Contractor's methods, equipment or appliances are inefficient or inappropriate for securing quality of work or rate of progress intended by contract documents or Contract, Owner may order Contractor to improve their quality or Increase their efficiency. This will not relieve Contractor or his/her sureties from their obligations to secure quality of work and rate of progress specified in Contract. 43, With reference to reflected ceilings, Contractor shall coordinate with all trades involved and prepare composite shop drawings to insure locations and clearances for fixtures, ducts, ceilings, sprinkler heads, grilles, etc., necessary to maintain the specified finish ceiling height above the finish floor as noted on the drawings. Clarify conflicts and locations with Architect before proceeding. 44. All telephone and data work shall be coordinated by the Contractor with the Owner's representative. 45. Architect, acting as Owner's designated agent for design of the project, will exercise sole authority for determining conformance of materials, equipment and systems with the intent of the design. Review and acceptance of all items proposed by Contractor for incorporation into this work will be by Architect. This function of the Architect will apply both to the contract as initially signed, and to changes to the contract by modification during the progress of work. 46. References to makes, brands, models, etc., is to establish type and quality desired: substitution of acceptable equals will not be permitted unless specifically noted otherwise or when made according to procedures for substitutions. 47. Coring, drilling or other noisy work in or adjacent to occupied areas shall be preformed at other than normal working hours for the affected occupancy unless otherwise approved by the Owner. 48, All work in occupied areas shall be performed at other than normal working hours unless otherwise approved. The affected premises shall be cleaned and restored to normal operating conditions unless otherwise indicated. 49. The Contractor shall take all reasonable control to eliminate dust and to keep site clean and well organized. 50. The Contractor shall "strike out" location of walls, doors, mullions, soffits, raised floor grids, housekeeping and utility t pads, and other major elements, or as directed by the Architect, at the beginning 01 equipment before proceeding with construction. 5 1. Discrepancies between Specifications, General Con "jons, General Notes, Drawings or Sheet Notes shall be brought to the Architect's attention for clarification or resolution. 52. Occasional reference to one or more specific notes within the General, Plan or Sheet Notes shall not in any way diminish or eliminate the full force and effect of all other notes, in relation to one another or not specifically referenced. 8. Potential pollutants include but are not limited to. solid or liquid chemical spills; wastes from paints, stales, sealants, glues, limes, pesticides, herbicides, wood preservatiww and solvents; asbestos fibers, Paint flakes or stucco fragments,, fuels, oils, lubricants, and hydraulic, radiator or battery fluids; fertilizers, vehicle/equipment wash water and concrete wash water, concrete, detergent or itoatable wastes; wastes from any engine/equipment steam clewing or chemical degreasing and superchlotiated potable water line flushing. During construction, permittee shall dispose of such materials in a specified and controlled temporary area on-ske, physically separated from potential stormwater runoff, with ultimat disposal in accordance with local, state and federal requirements. 9. Dewatering of contaminated groundwater, or discharging contaminated soils via surface erosion is prohibited. Dowatering of non -contaminated groundwater requires a NatiorW Pollutant Discharge Elimination System Permit from the respective State Reglorml Water Control Board. 10. Graded arm on the permitted area perimeter must drain away from the face of slopes at the conclusion of each working day. Drainage Is to be directed toward desilting facilities. 11. The permittee and contractor shall be responsible and shall take necessary precautions to prevent public trespass onto areas where impounded water creates a, hazardous condition. 12.
