RESTRICTIV E COVENAN T AND AGREEMEN T

"Subjec t Property " shall mean Assessor s Parcel Numbe r 403-173-1 2 in the County of
Orange, City of Santa Ana, commonl y referred to as 1915 South Orang e Avenue , and
more particularl y describe d in Exhibi t A hereto , which is incorporate d herein by this
referenc e a s thoug h full y se t forth .
THIS AGREEMEN T is between the City of Santa Ana, a charter city duly
organize d under the Constitutio n and laws of the State of Californi a (the "City") and the
fee title owner of the Subjec t Propert y (herein describe d as "Owner," whethe r singula r or
collective): Juan J. Sandova l and Eduwiges Sandoval .
The Owner hereb y covenant s and agrees, on Owner's behalf and on behalf of the
Owner's successor s and assigns , that Owner shall continuousl y occupy one of the two
residentia l dwellin g units on the Subjec t Property , consisten t with the Second Dwellin g
Unit standard s as prescribe d in City of Santa Ana Ordinanc e No. NS-2829 , as it may be
amende d from time to time.
In addition , Owne r hereby covenant s and agrees , on Owner's behal f and on behalf
of its successor s and assigns, that the two dwellin g units on the Subject Propert y shall not
both be rented at the same time. Finally , Owner warrant s and covenants , on Owner's
behalf and on behalf of its successor s and assigns , that Owner shall not seek to sell or
transfer title of one of the dwelling units on the Subjec t Propert y separate and apart from
a sale or transfer of title of the entire Subjec t Property.
This Restrictiv e Covenan t and Agreemen t shall run with the land and shall be
binding upon Owner, any future owner , or Owner's successo r or assign , and shall
continu e in effect in perpetuit y unless and until such time that the Santa Ana Municipa l
Code unconditionall y permit s the use or purpose herei n above referre d to or unless
otherwise released by authorit y of the Planning Manage r of the City of Santa Ana.
Owner represents and warrants that it is the owner of the Subjec t Property and has
full authority to execute this Restrictive Covenant and Agreement.
