N-2018-126 3) Workers' Compensation and Employers Liability Insurance in accordance with the provisions of Section 3700 of the Labor Code. If Parties have any employees, Parties are required to be insured against liability for worker's compensation or to undertake self-insurance. Prior to commencing the performance of the work under this .MOU, Parties agree to obtain and maintain employer's liability insurance with limits not less than $1,000,000 per accident. 4) Sexual Abuse and Molestation coverage: $1,000,000 per occurrence/$1,000,000 aggregate. 5) Cyber Error and Omission $1,000,000 per occurrence/$ 1,000,000 aggregate. 6) The City of Santa Ana upon execution of this contract and periodically thereafter upon request, shall fintish the OCDE and CCPA with certificates of insurance evidencing such coverage. The certificate of insurance shall include a thirty (30) day non -renewal notice provision. The Commercial General shall name the County Superintendent, OCDE and CCPA and the Board of Education as additional insureds with respect to liability arising out of work or operations performed by the City. J. INDEMNIFICATION: The Parties shall defend, indemnify and hold harmless each other and their respective Board Members, council members administrators, employees, agents, attorneys, and contractors against all liability, loss, damage and expense (including reasonable attorneys' fees) each may incur resulting from or arising out of the opposite party's negligence or willful misconduct in the performance of this MOU. I) Neither organization will provide financial compensation to the other for any services provided under this MOU.
