Box 14184 <br />The Above Space For Recorder's Use On] <br />Project Name: OC Streetcar Pro <br />Address: Santa Ana, California <br />APN: 008-067-47 <br />Project Parcel No.: OCS-004-01 <br />THIS TRANSACTION IS EXEMPT FROM CALIFORNIA DOCUMENTARY TRANSFER TAX <br />PURSUANT TO SECTION 11922 OF THE CALIFORNIA REVENUE AND TAXATION CODE. <br />PUBLIC UTILITY EASEMENT <br />FOR VALUABLE CONSIDERATION, receipt and sufficiency of which is hereby acknowledged, <br />the CITY OF SANTA ANA, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California, ("Grantor") hereby grants to the ORANGE <br />COUNTY TRANSPORTATION AUTHORITY, A Public Entity ("Grantee"), a non-exclusive <br />public utility easement ("PUE") for the purpose of constructing, maintaining, repairing, relocating, <br />and adjusting, as applicable, underground utility and communication facilities and their <br />appurtenant fixtures and equipment, as required, in and under that certain real property situated in <br />the City of Santa Ana, County of Orange, State of California, which is described in Exhibit "A" <br />and depicted on Exhibit `B", both of which are attached hereto and made a part hereof. During the <br />Construction Period, OCTA's use and occupancy of the PUE will be exclusive, subject to the rights <br />and limitations set forth below. OCTA's use and occupancy of the PUE prior to and after the <br />Construction Period will be non-exclusive. <br />Rights and Limitations of Use and Occupancy of PUE: <br />• OCTA shall provide the owner(s) and occupant(s) of the property subject to this PUE a <br />minimum of thirty (30) -days written notice as to when the Construction Period will <br />commence. <br />• During the Construction Period, OCTA may place a temporary fence around the PUE area. <br />• Reasonable pedestrian access to the property shall be maintained at all times <br />• Access to the PUE area shall be from public right of way. <br />• Driveway access will be maintained at all times. <br />• The following improvements within the PUE area will be removed as needed by OCTA to <br />allow for construction activities.
