REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: CLERK OF COUNCIL USE ONLY: <br />AUGUST 21, 2018 <br />APPROVED <br />TITLE <br />APPROVE A COOPERATIVE <br />❑ As Recommended <br />AGREEMENT WITH THE COUNTY OF <br />E]Amended <br />E]OOrrdinance on 1s' Reading <br />ORANGE AND VARIOUS AGENCIES <br />❑ Ordinance on 2nd Reading <br />TO FUND TOTAL MAXIMUM DAILY <br />❑ Implementing Resolution <br />LOAD PROGRAMS AND RELATED <br />❑ Set Public Hearing For <br />ACTIVITIES IN THE NEWPORT BAY <br />WATERSHED <br />(STRATEGICPLAN NO. 5,2) <br />CONTINUED TO <br />FILE NUMBER <br />CITYjMANAGER <br />Authorize the City Manager and the Clerk of the Council to execute cooperative Agreement No. <br />MA -080-18011416 with the County of Orange and other Newport Bay watershed dischargers to <br />fund Total Maximum Daily Load programs and related activities in the Newport Bay Watershed <br />for a five-year term beginning upon approval and execution by all parties and expiring June 30, <br />2023, and establishing the initial Fiscal Year 2018-19 estimated budget of $1,322,597, of which <br />the City of Santa Ana's share of $119,934, subject to nonsubstantive changes by the City <br />Manager and City Attorney. <br />DISCUSSION <br />Authorized by the Federal Clean Water Act, the National Pollutant Discharge Elimination System <br />(NPDES) permit program was established in 1972 to mitigate pollutant discharges to waters of <br />the United States and to maintain water quality standards. In California, this program is regulated <br />by the State Water Resources Control Board through its nine Regional Water Quality Control <br />Boards. <br />Approximately 60 percent of the City s surface area drains to Newport Bay via four major County <br />flood control channels: The Santa Ana -Delhi Channel, Santa Ana Gardens Channel, Santa Ana <br />Santa Fe Channel, and Lane-Barranca Channel (Exhibit 1). Newport Bay and some of its <br />tributaries are identified on the State Water Resources Control Board 303(d) List of Impaired <br />Waters for multiple pollutants. The Clean Water Act requires the development of a Total <br />Maximum Daily Load (TMDL) for each listed pollutant in order to protect the beneficial uses of <br />the water body. TMDLs also include requirements for studies, water quality monitoring, and the <br />development of specialized programs, work plans, and projects to meet water quality standards. <br />25K-1 <br />
