Huizar <br />Jamboree Housing Corporation ("Developer") has submitted an application as an approved and <br />certified Community Housing Development Organization ("CHDO") in response to the City of <br />Santa Ana's Request for Qualifications issued on September 26, 2016. The application is for a <br />project located at 3312 West 1St Street, Santa Ana, CA 92703 to create 75 permanent supportive <br />housing units with wrap-around supportive services for homeless veterans ("Project"). On <br />February 7, 2017 the City Council authorized the use of CHDO HOME Investment Partnerships <br />Program funds by an eligible CHDO. The City has evaluated the Developer's application and <br />authorized issuance of this pre -commitment letter evidencing the preliminary award of a HOME <br />Investment Partnerships Program Loan ("HOME Loan") for the Project under 24 CFR <br />92.504(c)(3). The purpose of this letter is provide a pre -commitment from the City of Santa Ana <br />for a loan of up to $504,550. <br />The City of Santa Ana has made the Developer aware of the 2013 HOME Final Rule, specifically <br />including the amendments to the definition of "commitment" in 24 CFR 92.2 that prohibits the <br />City as a Participating Jurisdiction from providing a commitment (as the term is defined therein) <br />of HOME Program funds to any specific local project until "the [City] and project owner <br />[Developer] have executed a written legally binding agreement under which HOME assistance <br />will be provided to the owner for an identifiable project for which all necessary financing has been <br />secured, a budget and schedule have been established, and underwriting has been completed and <br />under which construction is scheduled to start within twelve months of the agreement date." <br />Notwithstanding the definition of "commitment" in 24 CFR 92.2 as amended by the 2013 HOME <br />Final Rule, 24 CFR 92.504(c)(3) authorizes the City to "preliminarily award HOME funds for a <br />SANTA ANA CITY COUNCIL <br />Mguel A.
