C. On August 21,2018, the City Council of the City of Santa Ana held a duly <br />noticed public hearing to consider all testimony, written and oral, related to <br />Subsequent Final Environmental Impact Report No. 2018-15 (SCH No. <br />2006031041), General Plan Amendment No. 2018-03, Amendment <br />.Application No. 2018-06; and Zoning Ordinance Amendment No. 2018-02 <br />for the Metro East Mixed Use Overlay Zone expansion and amendments <br />project, at which time all persons wishing to testify were heard, the project <br />was fully considered, and all other legal prerequisites to the adoption of <br />this Resolution occurred. <br />D. Pursuant to the California Environmental Quality Act (Pub. Res. Code sec. <br />21000 et seq.; "CEQA"), and the State CEQA Guidelines the City has <br />determined that a Subsequent Environmental Impact Report (SEIR) <br />should 'be prepared pursuant to CEQA in order to analyze all potential <br />adverse environmental impacts of the proposed project. <br />Pursuant to Public Resources Code section 21067' and the State <br />CEQA 'Guidelines (Cal. Code Reg., tit. 14 Sec 15000 et seq.) <br />section 15051, the City is the lead agency for the proposed Project. <br />2. In accordance with CEQA, the recommended actions have been <br />reviewed through an SEIR. Sections 15080 through 15097, and <br />15162 of the State CEQA Guidelines (Article 7) guide the process <br />for the preparation of an EIR and an SEIR. <br />3. The California Environmental Quality Act (CEQA) requires that, <br />where there is the potential for environmental impacts as the result <br />of a proposed project, an EIR be prepared in order to study and <br />analyzeany potential environmental impacts, disclose such <br />potential impacts to the public, and mitigate such impacts to the <br />greatest extent feasible. As such, an EIR was prepared for the <br />original MEMU Overlay Zone in 2007 and was subsequently <br />certified by the City Council. <br />4. An SEIR is prepared when an EIR has been certified for a project <br />and the lead agency determines that one or more of the criteria <br />listed under Section 15162 and 15163 of the State 'CEQA <br />Guidelines are met. The City has determined that an SEIR is the <br />most appropriate environmental document due to the <br />.characterization of the proposed changes to the .project that was <br />previously approved with the certified Final EIR for the MEMU <br />Overlay Zone in 2007. The current SEIR has been prepared <br />pursuant to the requirements of CEQA and discloses. the <br />Resolution No. 2018-xx <br />75A-19 <br />
