PUBLIC COMMENTS — NONE <br />RECESSED AT 5:15 P.M. AND CONVENED IN ROOM 147 FOR CLOSED SESSION <br />DISCUSSION. <br />CITY COUNCIL CONVENED IN THE COUNCIL CHAMBER TO TAKE FOLLOWING <br />ACTION AT 5:18 P.M. AND RETURNED TO ROOM 147 FOR CONTINUED <br />DISCUSSION. <br />AGENDA ITEM ADDED <br />Pursuant to Government Code Section 54954.2 (b), there was a need to take immediate <br />action on an item and the need for action came to the attention of the local agency <br />subsequent to the posting of the agenda; City Attorney Carvalho requested that the <br />following item be added to the Agenda: <br />1. CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION <br />pursuant to paragraph (1) of subdivision (d) of Section 54956.9 of the <br />Government Code: <br />c. Orange County Catholic Worker, et al. v. Orange County, et al.., U.S. <br />District Court (Central District of California), Case No. SA CV 18 -0155 - <br />DOC (KESx); <br />MOTION. It was moved by Councilmember Benavides, seconded by <br />Mayor Pro Tem Martinez, to add emergency item to Closed Session <br />Agenda. Motion carried 6-0 (Tinajero absent). <br />CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain <br />matters without members of the public present. The City Council finds, based on advice <br />from the City Attorney, that discussion in open session of the following matters will <br />prejudice the position of the City in existing and anticipated litigation: <br />1. CONFERENCE WITH LEGAL COUNSEL --EXISTING LITIGATION <br />pursuant to Paragraph (1) of subdivision (d) of Section 54956.9 of the <br />Government Code: <br />a. Rita Marie Gomez, et al. v. City of Santa Ana, Orange County Case No. <br />30-2017-00898044-C U-PO-CJC <br />b. Theresa Le v. City of Santa Ana, et al., Orange County Superior Court, <br />Case No. 30-2018-00988425-CU-CR-CJC <br />CITY COUNCIL MINUTES 2 SEPTEMBER 4, 2018 <br />10A-2 <br />
