2.1 APPLICABLE REGULATIONS <br />These provisions shall apply to all properties within the <br />MEMU Overlay Zone, but do not supersede the <br />underlying zoning districts. All new development within <br />the MEMU Overlay Zone will be subject to the <br />requirements and improvements required in the Metro <br />East Public Realm Amenity Plan, which is included as an <br />Appendix. Definitions of terms not found within the <br />MEMU Overlay Zone are found within SAMC Chapter <br />41, Article 1, Division 2. <br />2.2 CONTINUANCE OF DEVELOPMENT <br />RIGHTS UNDERLYING ZONING <br />DISTRICT STANDARDS <br />All regulations, development standards, and requirements <br />in the underlying zoning districts shall continue to apply to <br />those properties that are currently developed according to <br />the existing standards. New properties may also be <br />developed to the existing underlying zoning district <br />provided that all standards and requirements of the <br />underlying zone are met. <br />2.3 OPTION TO APPLY THE MEMU OVERLAY <br />ZONE <br />Properties within the MEMU Overlay Zone may choose to <br />develop to the standards of the underlying zoning districts <br />or to the standards contained within this MEMU Overlay <br />Zone. In order to exercise the option to develop under the <br />MEMU Overlay Zone district, a MEMU Site Plan Review <br />application approved by the Planning Commission shall be <br />required. In granting such approval, the Planning <br />Commission must find that the proposed development is <br />in compliance with the provisions of the MEMU Overlay <br />Zone and the Findings in Section 8.2 of this code section. <br />In order to facilitate project and site design consistent <br />with the provisions of this MEMU Overlay Zone, any <br />development proposal for exercising use of the MEMU <br />Overlay Zone shall be designed so that any primary use <br />within the development is located within a newly <br />constructed building. No primary use or uses shall be <br />located in a building that has been rehabilitated or is <br />otherwise the reuse of an existing building. <br />2.4 USE OF PHOTGRAPHS <br />Photographs are used liberally throughout this <br />document and are intended for illustrative purposes <br />only. Specific development standards and regulations <br />contained in this document are the controlling <br />language for purposes of development regulation. <br />
