N-2018-190 <br />to persons or property, losses, costs, penalties, obligations, or liabilities, that may be assessed <br />or claimed by any person, firm or entity against the settlement or settlement proceeds being <br />paid to Claimant under this Release. <br />7. The undersigned does hereby affirm and acknowledge that he has read the <br />foregoing Release, or had it fully explained to him and fully understands and appreciates the <br />foregoing words, terms, and their effect, and that this is a full and final compromise, release <br />and settlement of all claims, demands, actions or causes of actions known or unknown, <br />suspected and unsuspected. <br />8. Claimant further declares and represents that no promise, inducement or <br />agreement not expressed in this Release has been made to Claimant, and this Release contains <br />the entire agreement between the parties to this Release, and the terms of this Release are <br />contractual and not a mere recital. <br />9. This Release and settlement extends and applies to all unknown, unsuspected <br />and unanticipated injuries and damages, as well as those which are now disclosed, and <br />Claimant hereby affirms he has affixed his signature hereto voluntarily and of his own free <br />will and accord. This Release contains the entire agreement between the parties and the terms <br />of this Release are contractual and not merely a recital. Claimant and City intend to be bound <br />by the terms of this Release. <br />10. Should any provision of this Release be declared or determined by any court of <br />competent jurisdiction to be illegal, invalid, or unenforceable, the legality, validity, and <br />enforceability of the remaining parts, teras orprovisions shall not be affected thereby and said <br />illegal, unenforceable or invalid part, terra, or provision shall be deemed not to be part of this <br />Release. <br />CLAIMANT ACKNOWLEDGES THAT SUBMISSION OF A FALSE CLAIM IS A <br />FELONY UNDER CALIFORNIA PENAL CODE §72.
