the existence of external circumstances beyond the employee's control make it <br />impossible for him or her to report for duty; or e) attend to medical or dental <br />appointments for members of the employee's household or family member as <br />defined above. <br />10.2 Military Leave. <br />A. Proof of Orders and Reinstatements. An employee shall be granted military <br />leave if he or she furnishes the Executive Director of Personnel Services <br />satisfactory proof of his or her order to report for duty. Upon return and upon <br />showing of proof of actual service pursuant to such orders, he or she will be <br />reinstated as provided by law. <br />B. Temporary. Members of the reserve forces of the United States, or the National <br />Guard, granted temporary leave when ordered to duty, will be granted leave <br />with pay not to exceed thirty, (30) working days in each calendar year after the <br />hourly equivalent of one (1) year of service with the City upon presenting <br />satisfactory proof of orders to and from such temporary active duties. <br />10.3 fury and Witness Leave. When an on -duty employee is called to serve as a juror <br />or nonparty witness in any court action, he or she shall be allowed to leave for the <br />time actually required for such service, not to exceed six (6) hours per day, without <br />loss of pay. Each on -duty employee called for such service shall present to his or <br />her Executive Director for examination the subpoena calling him or her to such <br />service and shall pay into the City Treasury the fees collected for such service, with <br />the exception of reimbursement for transportation expenses, if any. <br />10.4 Examination Leave. Employees participating in examinations conducted during <br />their normal working hours for positions in the competitive service of the City of <br />Santa Ana will be granted leave with pay for the time actually required. <br />10.5 Unauthorized Absence. Unauthorized absence from duty for any duration of time <br />may be considered cause for dismissal. Absence from duty without leave for five <br />(5) consecutive working days shall be deemed a resignation from service; <br />provided, however, if upon return to duty the person so absenting himself or <br />herself makes an explanation satisfactory to the Executive Director regarding the <br />cause of his or her absence, the Executive Director may restore him or her to his or <br />her position, with the City Manager's approval. <br />28 <br />
