by Government Code section 53723, and therefore must be approved by a majority of <br />voters voting in an election on the tax. Approval of this Ordinance is therefore subject to <br />and conditioned upon the approval by the voters of the imposition of the general tax <br />imposed by this Ordinance. If a majority of the voters voting in the election do not vote <br />in favor of the imposition of the tax, this ordinance shall not take effect. <br />SECTION 4. Severability. If any provision of this Ordinance or the application <br />thereof to any person or circumstances is held invalid, such invalidity shall not affect <br />other provisions of applications of the Ordinance that can be given effect without the <br />invalid provision or application, and to this end the provisions of this Ordinance are <br />severable. This City Council hereby declares that it would have adopted this Ordinance <br />irrespective of the invalidity of any particular portion thereof and intends that the invalid <br />portions should be severed and the balance of the Ordinance be enforced. <br />SECTION 5. Effective Date. After its adoption by the voters, this Ordinance <br />shall be in full force and effect ten (10) days after the vote is declared by the legislative <br />body, pursuant to the provisions of Elections Code sections 9217 and 15400 and as <br />provided by law. <br />PASSED, APPROVED, and ADOPTED by the People of the City of Santa Ana <br />this 6th day of November, 2018. <br />ATTEST: <br />Maria D.
