SECTION 1. Recitals. The above recitals are hereby found to be true and <br />accurate and are incorporated into this Ordinance by this reference. <br />SECTION 2. Amendment. Article XIII is hereby added to Chapter 21 of the City <br />of Santa Ana Municipal Code to read in full as set forth in Exhibit A-1, attached hereto <br />and incorporated by reference. <br />SECTION 3. Voter Approval. Article XIII as added to Chapter 21 of the Santa Ana <br />Municipal Code by this proposed Ordinance shall impose a general tax as defined by <br />Government Code section 53723, and therefore must be approved by a majority of voters <br />voting in an election on the tax. Approval of this Ordinance is therefore subject to and <br />conditioned upon the approval by the voters of the imposition of the general tax imposed <br />by this Ordinance. If a majority of the voters voting in the election do not vote in favor of <br />the imposition of the tax, this ordinance shall not take effect. <br />SECTION 4. Severability. If any provision of this Ordinance or the application <br />thereof to any person or circumstances is held invalid, such invalidity shall not affect other <br />provisions of applications of the Ordinance that can be given effect without the invalid <br />provision or application, and to this end the provisions of this Ordinance are severable. <br />This City Council hereby declares that it would have adopted this Ordinance irrespective <br />of the invalidity of any particular portion thereof and intends that the invalid portions should <br />be severed and the balance of the Ordinance be enforced. <br />SECTION 5. Effective Date. After its adoption by the voters, this Ordinance shall <br />be in full force and effect ten (10) days after the vote is declared by the legislative body, <br />pursuant to the provisions of Elections Code sections 9217 and 15400 and as provided <br />by law. <br />PASSED, APPROVED, and ADOPTED by the People of the City of Santa Ana this <br />6th day of November, 2018. <br />ATTEST: <br />Maria D.
