City of Santa Ana <br />Correction of the service or performance deficiency, or substantial <br />inadequacy, shall occur within a period of not to exceed sixty (60) <br />days from the development of the CAP, unless the OCFA <br />representative determines that correction cannot be accomplished <br />within the specified time frame. When correction will take longer <br />than sixty (60) days from the development of the CAP, the CAP <br />shall specify interim dates by which specific steps toward <br />correction of the service or performance deficiency, or substantial <br />inadequacy, will take place with the total time period not to exceed <br />three (3) months. <br />iii. CAP Inspection/Compliance <br />The Fire Chief or his designee, shall visit and inspect Contractor's <br />business office, facilities, vehicles, personnel, and/or records to <br />review and document actions taken by Contractor to implement the <br />CAP and shall document any continuing service or performance <br />deficiency, or substantial inadequacy, which is not corrected within <br />the specified time frame. In the event Contractor fails to correct the <br />service or performance deficiency, or substantial inadequacy <br />identified in the CAP within the time frame provided, OCFA may <br />find Contractor to be in material breach of the Agreement. <br />D.Timely Performance Required <br />Assessment of penalties or the imposition of a CAP, pursuant to this <br />Section will not relieve Contractor of the responsibility to meet all <br />performance expectations as set forth in the Contract Documents. <br />Substandard cumulative response time performance (i.e., below the 90% <br />compliance rate for combined Code 2 and Code 3 calls) in any two (2) <br />quarters in a single twelve (12) month period will constitute breach of <br />contract, resulting in the imposition of a Remedial Action Plan (RAP). <br />City of Santa Ana Page 147 <br />Fire/EMS Emergency Ambulance Transportation and Related Services <br />Request for Proposals: # 18-059 <br />August 28, 2018 <br />p7pWO O <br />
