DEDUCTIBLES <br />The State may expressly allow deductible clauses, which it does not <br />consider excessive, overly broad, or harmful to the interests of the State. <br />Regardless of the allowance of exclusions or deductions by the State, the <br />Contractor is responsible for any'deductible amount and shall warrant that <br />the coverage provided to the State is in accordance with Section 2(b), <br />"Insurance." <br />1. The Department may assure the Contractor's compliance with its <br />insurance obligations. Ten days before an insurance policy lapses <br />or is canceled during the contract period, the Contractor shall submit <br />to the Department evidence of renewal or replacement of the policy. <br />2. If the Contractor fails to maintain any required insurance coverage, <br />the Department may maintain this coverage and withhold or charge <br />the expense to the Contractor or terminate the Contractor's control <br />of the work. <br />3. The Contractor is not relieved of its duties and responsibilities to <br />indemnify, defend, and hold harmless the State, its officers, agents, <br />and employees by the Department's acceptance of insurance <br />policies and certificates. <br />4. Minimum insurance coverage amounts do not relieve the Contractor <br />for liability in excess of such coverage, nor do they preclude the State <br />from taking other actions available to it, including the withholding of <br />funds under this contract. <br />25G-45 <br />
