CITY OF SANTA ANA <br />PROPOSAL <br />PROJECT NOS.: 16-6864 AND 18-6864 <br />OMNIBUS CONCRETE REPAIR PROJECT <br />"No discrimination shall be made in the employment of persons upon public works because of <br />the race, religious creed, color, national origin, ancestry, physical handicap, medical condition, <br />marital status, or sex of such persons except as provided in Section 1420, and every contractor <br />for Public Works violating this Section is subject to all penalties imposed for a violation of the <br />Chapter." <br />A copy of the Certification of Nondiscrimination by Contractors is provided in the Bid Proposal <br />section of these Contract Documents. <br />STATEMENT REGARDING APPRENTICESHIP REQUIREMENTS <br />Bidders shall be familiar with the requirements of Section 1777.5 of the California State Labor <br />Code regarding employment of apprentices and shall submit a Statement Regarding <br />Apprenticeship Requirements with the Bid Proposal. A copy of the Statement is provided in the <br />Bid Proposal section of these Contract Documents. <br />STATEMENT REGARDING "ANTI -KICK -BACK" REQUIREMENTS <br />Bidders shall be familiar with, and shall agree to comply with, the Copeland "Anti -Kickback" <br />Act (18 USC 74) as supplemented in the Department of Labor regulations (29 CFR, Part 3), and <br />shall submit a Statement Regarding "Anti -Kickback" Requirements with the Bid Proposal. A <br />copy of the Statement is provided in the Bid Proposal section of these Contract Documents. <br />CONSTRUCTION CONTRACT AGREEMENT. BONDS & INSURANCE <br />The Construction Contract Agreement, Sample Bonds and Insurance Requirements are all <br />included as appendices in the project Contract Documents. <br />Following authorization by City Council to award a Construction Contract, written notification <br />will be given by the AGENCY to the successful BIDDER who will, within ten (10) business <br />days, submit to the Agency the completed and signed Construction Contract Agreement, a <br />Performance Bond, a Payment Bond, and evidence of Worker's Compensation Insurance. <br />Failure to execute a contract and submission of acceptable bonds and insurance as provided <br />herein within the time limit above may be just cause for the annulment of contract award and the <br />forfeiture of the bid proposal guarantee. <br />No contract shall be binding upon the AGENCY until it has been completely executed by the <br />Contractor, approved by the City Attorney, and executed by the AGENCY. <br />After the AGENCY executes the Contract and approves the bonds and certificates of liability <br />insurance, the AGENCY will send the successful BIDDER a copy of the fully executed <br />Construction Contract Agreement. <br />RETURN OF PROPOSAL GUARANTIES <br />Within ten (10) days after the award of the contract, the AGENCY will return the proposal <br />guaranties, other than Bid Bonds, except any guaranties that have been forfeited. <br />23 EM11 <br />
