ARTICLE XIV <br />14.0 RELEASE TIME FOR ASSOCIATION REPRESENTATIVE <br />During the term of this MOU, the City agrees to grant full-time release from duty for one (1) <br />Association representative for the conduct of Association affairs subject to the following: <br />14.1 The POA Association President cost shall be paid one hundred percent (100%) of salary <br />including any salary additives, such as career incentive pay, confidential premium pay, <br />benefit costs and pension cost. All Association members shall donate one floating holiday <br />annually to city as reimbursement for 100% of the cost of the Association President <br />salary, additives, such as career incentive pay, pension and benefit costs. <br />A. The City shall pay the POA President a "Confidential Premium" in lieu of 20 <br />hours per pay period at time and one-half. This premium is contained in the <br />California Public Employees' Retirement Law (PERL) and is described as <br />"compensation to rank and file employees who are routinely and consistently <br />assigned to sensitive positions requiring trust and discretion." The parties agree <br />that the value of this premium shall be equivalent to 28 hours of pay at straight <br />time per pay period. The rate paid shall be tied to the incumbent's rank. The <br />POA agrees that the acceptance of said compensation as "PERSable" is subject to <br />PERS approval. <br />B. The Police Chief shall allow on -duty time, (up to three days) for five board <br />members, once per year, to attend the Peace Officers' Memorial. The Police <br />Chief shall allow on -duty time (up to four days) for five board members, once per <br />year, to attend the Fraternal Order of Police ("FOP") training. POA will pay for <br />all costs for the board members attendance at said events, including per diem, <br />travel, hotel, etc. If the Memorial or FOP falls on a board members normal day <br />off, they will not receive on -duty pay for attendance. <br />C. The City agrees to grant up to a total of sixty hours (60) per fiscal year on a non- <br />cumulative basis to enable the POA members, officers, worksite leaders/stewards, <br />to conduct Union business and assist other bargaining unit employees in <br />processing grievances under the Grievance Review Procedure; provided, <br />however, that such POA members officers, worksite leaders/stewards and <br />aggrieved employees shall make advance arrangement with their supervisors prior <br />to absenting themselves for such purpose. The officers, worksite leaders/stewards <br />and aggrieved employees shall be required by the City to record and report to <br />their supervisors the work time spent in assisting other bargaining unit employees <br />pursuant to this provision of the MOU. <br />14.2 The Association shall provide an insurance policy or policies, or certificate of such <br />insurance, naming the City of Santa Ana, its officers, employees and agents as insured or <br />additional insured, which provides coverage against liability for any and all claims and/or <br />suits for damages or injuries to persons or property resulting from or arising out of any <br />act or omission of said Association representative. Said policy or policies of insurance <br />shall provide coverage for both bodily injury and property damage in not less than the <br />52 <br />
