REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />FEBRUARY 19, 2019 <br />TITLE: <br />APPROVE AN APPROPRIATION ADJUSTMENT <br />TO RECEIVE OCTA MEASURE M2 GRANT <br />FUNDING AND AWARD A CONSTRUCTION <br />CONTRACT TO STL LANDSCAPE, INC., FOR <br />THE MABURY PARK STORMWATER <br />CAPTURE PROJECT (PROJECT 19-6425) <br />(STRATEGIC PLAN NO. 6, 1C & 1G) <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 15' Reading <br />❑ Ordinance on 20d Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For_ <br />CONTINUED TO <br />� 1 C' - FILE NUMBER <br />CITY MANAGER <br />RECOMMENDED ACTION <br />Approve an appropriation adjustment recognizing $380,000 in Measure M2 grant funds for the <br />Mabury Park Stormwater Capture Project in the Measure M2 Competitive -Street Construction <br />Revenue Account and appropriating the same into the Measure M2 Competitive -Street <br />Construction Expenditure Account. <br />Award a contract to STL Landscape, Inc., the lowest responsible bidder, in accordance with <br />the base bid of $328,160, for the term beginning upon execution of the contract and ending <br />upon project completion, for construction of the Mabury Park Stormwater Capture Project, and <br />authorize the City Manager and Clerk of the Council to execute the contract subject to <br />nonsubstantive changes approved by the City Manager and City Attorney. <br />3. Approve the Project Cost Analysis for a total estimated construction delivery cost of $475,000, <br />which includes the contract bid amount, administration, inspection and testing, and an <br />authorized contingency of $97,616. <br />DISCUSSION <br />On May 1, 2018, City Council approved Resolution No. 2018-30, authorizing staff to submit <br />applications to the Orange County Transportation Authority (OCTA) for funding under the OC Go <br />Environmental Cleanup Program, Tier 1 Fiscal Year 2018-19. On October 18, 2018, in Letter <br />Agreement No. 15 (Exhibit 1), OCTA amended the M2 CTFP Master Funding Agreement (C-1- <br />2783) and awarded the City $380,000 for construction of the Mabury Park Stormwater Capture <br />Project. <br />Mabury Park is located within the Newport Bay Watershed. Newport Bay is on the State Water <br />Resources Control Board 303(d) List of Impaired Waters for multiple pollutants. The Mabury <br />Park Stormwater Capture Project features the construction of a bioretention basin in Mabury <br />20C-1 <br />
