REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MARCH 5, 2018 <br />TITLE: <br />APPROVE AN EXTENSION OF <br />CONDITIONAL USE PERMIT NO. 2015-01 <br />AND VARIANCE NOS. 2015-01 AND 2015-02 <br />FOR THE SOUTH COAST SPEEDWASH TO <br />BE LOCATED AT 2402 SOUTH BRISTOL <br />STREET <br />(STRATEGIC PLAN NO. 3,2) <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on I�' Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />It is recommended that the City Council adopt a resolution approving the third and final extension <br />of Conditional Use Permit No. 2015-01 and Variance Nos. 2015-01 and 2015-02. <br />DISCUSSION <br />In April 2015, the City Council approved Conditional Use Permit (CUP) No. 2015-01 and Variance <br />Nos. 2015-01 and 2015-02 for the South Coast Speedwash development at 2402 South Bristol <br />Street. The conditional use permit allowed construction of an automated car wash in conjunction <br />with an administrative office building and a multiple -tenant commercial building, and the variances <br />were to allow a reduction in required setbacks and parking. Due to the complexities of the project <br />and the challenges of securing services required to engineer the mixed-use project site, which <br />includes a car wash, administration building, and a multi -tenant commercial building, the applicant <br />was unable to move forward with construction before the entitlements would have expired. <br />Pursuant to Section 41-647 of the Santa Ana Municipal Code (SAMC), CUPS, variances, and other <br />entitlements automatically become void should the property owner fail to institute an action to comply <br />with the provisions of the entitlements within two years of its approval. This section of the code also <br />allows the property owner to request an extension of the entitlement up to a period of three years <br />from the date of expiration. The first one-year extension was approved by City Council on March 7, <br />2017. The second one-year extension was approved by City Council on March 6, 2018. In December <br />2017, the City issued construction permits for the project. The applicant has commenced work on <br />constructing the perimeter walls surrounding the project site. However, due to continued complexities <br />of the project, the applicant has been unable to begin construction on the car wash, administrative <br />office, and commercial building. Although above -ground construction has yet to begin, the applicant <br />would like to maintain the entitlements for the CUP and variances and is requesting a third and final <br />one-year extension of the approvals.
