N-2019-025-01 <br />INSURANCE NOT REOUIRED <br />WORK MAY'PRC)GEED <br />CLERK OF COUNCIL <br />et,^rc• <br />MAR 1 12019 <br />AMENDMENT TO SETTLEMENT AGREEMENT N -2019-Q25 <br />WHYREAS. the City of Santa Ana on the one hand- and Envision Properties, LLC, <br />ame§ S Ilona and Kook II Hong on the other hand (hereinafter referred to collectively as the <br />"Parties") entered into Settlement Agreement N-7019-075 (hereinafter the "Settlement <br />Agreement' ), to resolve disputes arising, from the illegal use of and public nuisances upon, <br />oro-perty locatedat 902-914 N. Harbor. Santa Ana C'.Alifornia 92704 the REgRCrtfh attd <br />WHEREAS, Exhibit A to the Settlement Agreement contains an error with rospect to the <br />days on which the rear trate of the property is to be secured: and. <br />WHEREAS. the Parties desire to amend Exhibit A to the Settlement Aorcement to set <br />Port the correct days on which the rear Pate of the propertyis ,s to be secured. <br />NOW. TIJEREFORE, the Parties hereby agree as follows: <br />1. Section 1, I(a) of Exhibit A to the Settlement Agreement isherelryamgaded to <br />readas follows; <br />Sect rite and Surveillance <br />(a) Maintain and ensure that at least one (1) licensed and trained security guard is present <br />on the property and patrolling the property at least three days a week as follows: <br />Fridays: 10:00 p.rn. to 2:00 a.m. <br />Saturdays: 10:00 p.m. to 2:00 a.m. <br />Sundays: 10:00 p.m. to 2;00 a.m. <br />The security guard will be required to open and close the gate that secures the rear <br />parking lot at the property between the hours of 10:00 p.m. and 6:00 a.m. Sunday <br />through Saturday. <br />2. Section 5.1(a) of Exhibit A to the Settlement Agreement is hereby amended to <br />read as follows; <br />Ga e <br />(a) Install and maintain secure gate for the rear parking lot area. The security guard <br />will be required to open and close the gate that secures the rear parking lot at the Property <br />between dte hours of 10:00 p.m. and 6:00 a:m. Sunday through Saturday. <br />Except as set forth herein, all remaining terms of Settlement Agreement shall <br />remain in full force and et%et. <br />APPROVED AS TO FORM <br />
