the Police Chief or his designee. <br />207(k) 9/81 Work Schedule. Employees shall work 81 hours in a <br />consecutive 14 day, 336 hour period. This cycle shall be repeated <br />twice each 28 day FLSA Work Period. Employees shall work five <br />(5) nine hour workdays in one (1) seven (7) day span and four (4) <br />nine hour workdays in the second seven (7) day span. Each nine <br />hour workday shall consist of nine (9) hours of work and either a <br />30 minute or one (1) hour unpaid meal period. While assigned to <br />the 9/81 schedule, an officer shall earn two (2) hours of overtime <br />during each 28 day FLSA Work Period, unless he or she takes <br />leave without pay during the 28 day, 672 hour period. <br />3. During the term of this agreement upon request from the City, the Union <br />agrees to a reopener to discuss changes to the schedules listed above. <br />3.3 Part Time Employment. During the term of this MOU, no presently existing full-time <br />positions will be eliminated as the result of the use of part-time employee(s) and, to the <br />extent possible, when the workload of any one or more part-time employee(s) would <br />justify the addition of a full-time position or positions, the parties will meet and confer <br />regarding the addition of a full-time position or positions, subject to City Council <br />approval. <br />3.4 Code Seven. Except for those employees assigned to Patrol, other employees who do not <br />receive a paid meal period whose meal periods are interrupted by the performance of job <br />related duties, will receive another full, uninterrupted meal period or will be compensated <br />for their meal period at their overtime rate of pay at time and one-half their regular rate of <br />pay. For purposes of this section, "interrupted" shall mean a significant interruption of <br />more than a few minutes (de minimis). For employees who receive a one-hour lunch <br />period (half of which is paid) overtime compensation shall apply only to the unpaid half- <br />hour. Unless exigent circumstances exist beyond the Department's control, employees <br />assigned to Patrol shall be provided a 30 minute paid meal period. Should an employee's <br />meal period be interrupted, every effort shall be made to allow the affected employee to <br />resume his/her meal period for the remaining unused time, not to exceed the 30 minute <br />total meal period. <br />3.5 Detective Redeployment <br />All employees assigned as detectives (investigators) shall work one (1) day per month in <br />the patrol function of the Field Operations Bureau pursuant to a schedule as determined <br />by the Chief of Police or his designee. <br />Once each calendar year the Chief of Police shall conduct a review of the organization of <br />the Police Department to determine whether positions and assignments currently in the <br />Investigations Bureau represent a deployment of resources that best enables the <br />department to provide police services to the city. <br />The Chief of Police may, as a result of this review, remove positions and assignments <br />
