REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />APRIL 2, 2019 <br />TITLE: <br />APPROVE LEGAL SERVICES AGREEMENT <br />WITH TALLEY & TALLEY, APC, IN AN AMOUNT <br />NOT TO EXCEED $250,000 <br />(STRATEGIC PLAN NO. 1,3,4,5) <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1s' Reading <br />❑ Ordinance on 2ntl Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />0111111WHIM95 _--M: <br />Authorize the City Manager and Clerk of the Council to execute a legal services agreement with <br />the law firm of Talley & Talley, APC ("Attorneys") related to the provision of administrative and <br />litigation expertise concerning general liability, personnel and police matters. The term of the <br />agreement shall commence on July 1, 2019 and continue for a one-year term through June 30, <br />2020, in an amount not to exceed $250,000, subject to non -substantive changes approved by the <br />City Manager and the City Attorney. <br />DISCUSSION <br />The City Attorney's Office ("CAO") handles and manages a variety of transactional and litigation <br />matters, several requiring special expertise for a limited or extended duration of time depending on <br />the project or litigation. In the fall of 2018, the City engaged the law firm of Talley & Talley, APC, <br />to provide such expertise and the relationship has been positive, resulting in efficiencies handling <br />litigation matters collaboratively with in-house staff. The Talley agreement was funded with money <br />from the budgeted, but unfilled, position of Chief Assistant City Attorney. The agreement provided <br />for a monthly retainer. <br />The CAO now seeks to continue the agreement with Talley, but proposes to do so on an hourly <br />basis, rather than the monthly retainer, to assist and supplement in-house services for the City, on <br />an as needed basis <br />Approval of this item supports the City's efforts to meet Goal No. 1 Community Safety, Goal No. 3 <br />Economic Development, Goal No. 4. Government Financial Stability, and Goal No. 5 Community <br />Health, Livability, Engagement and Sustainability. <br />25A-1 <br />
