B. These Restrictions shall be recorded in the Official Records of the County, and shall <br />remain in first position on title and shall not be subordinated. <br />3.2 Affordability Levels/Unit Mix: <br />A. The Project shall consist of fifty-one (51) residential units (except for one (1) unit <br />for the onsite manager). The affordable rents charged at the Project must comply with the standards set forth <br />by the California Tax Credit Allocation Committee (TCAC). <br />C. Utility allowances must be deducted from the maximum gross monthly Affordable <br />Rent. The Housing Authority of the City of Santa Ana publishes a Utility Allowance <br />Schedule on an annual basis. <br />3.3 Calculation of Rent: <br />A. The affordable rents charged at the Project must comply with the standards set forth <br />by the California Tax Credit Allocation Committee (TCAC). <br />B. Utility allowances must be deducted from the maximum gross monthly Affordable <br />Rent. The Housing Authority publishes a Utility Allowance Schedule on an annual basis. <br />C. On an annual basis, the City shall provide the Developer with the maximum allowable <br />schedule of incomes and rents (less utility allowance appropriate for the Restricted Units for the <br />Property), which shall correspond to the maximum rent increase allowed by TCAC. In no event can <br />Developer charge any tenant more than such amount. <br />D. Developer, its successors and assigns, shall not charge rents for the Restricted' Units <br />in excess of the amounts set forth in the tables as adjusted from time -to -time by TCAC. The City's <br />Project Manager, or designee, shall notify Owner in writing of the adjusted allowable maximum <br />incomes and rents as allowed by TCAC. <br />E. In no event shall the rent charged to the tenant of a Restricted Unit be more than that <br />amount of the rent as published by TCAC on an annual basis. <br />
