CITY OF SANTA ANA BONDS Bond No. CAC716865 Executed in 3 originals PROJECT NO.: 19-6495 FIRST STREET UNDERCROSSING STORMWATER LIFT STATION WARRANTY PERFORMANCE AND PAYMENT BOND (To be submitted upon project completion as a condition of project acceptance) I{NOW ALL MEN BY THESE PRESENTS that ARNAZ Engineering Contractors, Inc. as CONTRACTOR, and Merchants Bonding Company (Mutual) a corporation, organized and existing under the laws of the State, and duly authorized to transact business under the laws of the State of California, as SURETY, are held and firmly bound unto the City of Santa Ana, as AGENCY, in the penal sum of One Hundred Fifty Seven Thousand Five Hundred Seventy Five and 00/100 Dollars ($157,575.00 ), which is 25 percent of the final contract amount for the above stated project, for the payment of which sum, CONTRACTOR and SURETY agree to be bound, jointly and severally, firmly by these presents. THE CONDITIONS OF THIS OBLIGATION ARE SUCH that, whereas CONTRACTOR has been awarded and is about to enter into the annexed Contract Agreement with AGENCY dated for Project No. 19-6495, First Street Undercrossing Stormwater Lift Station , if CONTRACTOR faithfully warrants the work done under said Contract Agreement against material or quality defects for a period of one year after acceptance by the AGENCY, then this obligation shall be null and void, otherwise it shall remain in full force and effect in favor of AGENCY; provided that any alterations in the obligations or time for completion made pursuant to the terms of the contract documents shall not in any way release either CONTRACTOR or SURETY, and notice of such alterations is hereby waived by SURETY.
