REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MAY 7, 2019 <br />TITLE: <br />APPROVE A DENSITY BONUS <br />AGREEMENT TO ALLOW A 552 UNIT <br />AFFORDABLE RENTAL PROJECT AT 2110, <br />2114, AND 2020 EAST FIRST STREET <br />(STRATEGIC PLAN NOS. 3, 2; 5,3) <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />•rnek <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1sl Reading <br />❑ Ordinance on 2o° Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO MAY 21 2019 <br />FILE NUMBER <br />Authorize the City Manager and Clerk of the Council to execute a Density Bonus Agreement with <br />Santa Ana Pacific Associates, and Santa Ana Pacific Associates II, or assigns, for a 55-year term, <br />for the development of a 552-unit affordable rental project at 2110, 2114, and 2020 East First <br />Street, subject to non -substantive changes approved by the City Manager and City Attorney. <br />PLANNING COMMISSION ACTION <br />At a Special Meeting on June 4, 2018, the Planning Commission recommended approval of the <br />Density Bonus Agreement No. 2017-02 by City Council as conditioned, to allow construction of a <br />552-unit affordable rental residential community at 2110, 2114, and 2020 East First Street located <br />in the Metro East Mixed Use Overlay District (OZ-1). Planning Commission approved the <br />recommended action by a vote of 4:1 (Bacerra opposed). <br />The Pacific Companies in partnership with Jamboree Housing ("Developer") is seeking to develop <br />a 552-unit affordable housing project at 2110, 2114 and 2020 East First Street ("Project"). In order <br />to do so, they have requested specific concessions permissible under California Density Bonus <br />Law and the City's Housing Opportunity Ordinance. While the Density Bonus Law is not going to <br />increase the number of units that they can actually build, the concessions will allow the Developer <br />to build the proposed number of units. The Developer is seeking approval of this Density Bonus <br />Agreement in order to receive their building permit and move forward on their Project. <br />Specifically, the California Density Bonus Law allows developers to seek increases in allowed <br />zoning density by providing additional affordable housing units on -site. To make development of <br />on -site affordable housing units feasible, the law allows developers to request incentives or <br />waivers, which are essentially variances from development standards.
