("Macy's") submits these comments for tonight's hearing regarding the <br />MalnPlace Mail Transformation Project. That project site encompasses real property owned by <br />Macy's and improved with a Macy's department store located at 2850 North Main Street Santa <br />Ana, CA 92705, <br />Macy's consent will be required before the MainPiace project can be implemented, pursuant to <br />Macy's certain approval rights under the governing reciprocal easement agreement, as <br />amended and supplemented and other instruments and agreements affecting the Macy's <br />property and governing the operation of the MainPiace Mali. The reciprocal easement <br />agreement and related agreements will need to be modified before the proposed development <br />can proceed. The Macy's team has been working with the project applicant on an acceptable <br />plan and previously requested that the applicant not seek any City Council approvals until our <br />concerns about the project were addressed, inclusive of without limitation, the major arterial <br />proposed along the Macy's store frontage. <br />Our concerns have not been addressed and we were surprised to learn just now that the project <br />was submitted to the City Council at its June 4, 2019 meeting for initial approvals, and for <br />adoption of ordinances approving a Specific Plan and a Development Agreement tonight. <br />Because the arterial issues and other concerns have not been resolved, Macy's objects to the <br />MainPiace project. Our objection extends to all proposed approvals and to the review of <br />environmental impacts. We believe there has not been adequate evaluation of all the <br />ramifications and impacts of siting a major arterial directly in front of our store, including impacts <br />related to transportation, air quality, greenhouse gas emissions, impediments to pedestrian <br />access to our store, and changes to the original project and in surrounding circumstances since <br />the EIR was certified In 1988. <br />We also request that special notice of any approvals, enactments, applications, permits, <br />proceedings, and notices (including CEQA notices) relating to the MainPiace Mall <br />Transformation Project be provided to the following, preferably by email: <br />196671541 7 West Seventh Street, Cincinnati, OH 45202 <br />
