WHEREAS, the Current Entitlements could be developed without any further <br />discretionary permits issued by the City; and <br />WHEREAS, when compared against the Originally Approved Plan, the <br />MainPlace Project represents a reduction of 200,000 square feet of commercial, a <br />reduction of 750,000 square feet of office, a reduction of 800 hotel rooms, and the <br />addition of 1,900 residential units; and <br />WHEREAS, when compared against the Current Entitlements, the MainPlace <br />Project represents a reduction of 109,255 square feet of commercial, a reduction of <br />750,000 square feet of office, no change in the number of hotel rooms, and the addition <br />of 1,900 residential units; and <br />WHEREAS, when compared against the existing MainPlace Mall, the MainPlace <br />Project would permit the addition of 270,000 square feet of commercial, the addition of <br />750,000 square feet of office, the addition of 400 hotel rooms, and the addition of 1,900 <br />residential units; and <br />WHEREAS, pursuant to the California Environmental Quality Act (Public <br />Resources Code section 21000 et seq.) ("CEQA") and the State CEQA Guidelines (14 <br />Cal. Code Regs. 15000 et seq.), the City is the Lead Agency for the MainPlace <br />Project; and <br />WHEREAS, pursuant to CEQA, when taking subsequent discretionary actions in <br />furtherance of a project for which an EIR has already been certified, the Lead Agency is <br />prohibited from requiring a subsequent or supplemental EIR unless at least one of the <br />circumstances identified in Public Resources Code section 21166 or State CEQA <br />Guidelines section 15162 are present; and <br />WHEREAS, City staff has evaluated the MainPlace Project and considered <br />whether, in light of the impacts associated with its development, any supplemental or <br />subsequent environmental review is required pursuant to Public Resources Code <br />section 21166 or State CEQA Guidelines section 15162; and <br />WHEREAS, based upon the analysis contained in the MainPlace Mall <br />Transformation Project EIR Addendum ("2019 Addendum") City staff has concluded that <br />none of the circumstances described in Public Resources Code section 21166 or State <br />CEQA Guidelines section 15162 have occurred, and thus no supplemental or <br />subsequent EIR is required; and <br />WHEREAS, on May 13, 2019 at a duly noticed public hearing, the Planning <br />Commission considered the 2019 Addendum and recommended its approval to the City <br />Council; and <br />WHEREAS, on June 4, 2019, at a duly noticed public meeting, the City Council <br />has reviewed the Addendum, along with the information in the 1983 EIR and the 1996 <br />Addendum, prior to taking action on the MainPlace Project; and <br />Resolution No. 2019-040 <br />Page 2 of 23 <br />
