LS 6.18.19 <br />RESOLUTION NO. 2019-050 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA ADOPTING LOCAL CEQA GUIDELINES FOR <br />IMPLEMENTING THE CALIFORNIA ENVIRONMENTAL <br />QUALITY ACT (PUBLIC RESOURCES CODE §§ 21000 ET <br />SEQ.) <br />WHEREAS, the California Legislature has amended the California Environmental <br />Quality Act ("CEQA") (Pub. Resources Code §§ 21000 et seq.), the Natural Resources <br />Agency has amended the State CEQA Guidelines (Cal. Code Regs, Title 14, §§ 15000 <br />et seq.), and the California courts have interpreted specific provisions of CEQA; and <br />WHEREAS, Public Resources Code section 21082 requires all public agencies <br />to adopt objectives, criteria and procedures for (1) the evaluation of public and private <br />projects undertaken or approved by such public agencies, and (2) the preparation, if <br />required, of environmental impact reports and negative declarations in connection with <br />that evaluation; and <br />WHEREAS, the City of Santa Ana has prepared local guidelines for <br />implementing CEQA to make them consistent with the current provisions and <br />interpretations of CEQA and the State CEQA Guidelines; and <br />WHEREAS, on May 28, 2019, the Planning Commission held a duly noticed <br />public hearing and recommended that the City Council adopt a resolution adopting the <br />"2019 Local Guidelines for Implementing the California Environmental Quality Act". <br />WHEREAS, on June 18, 2019, the City Council held a duly noticed public <br />hearing to consider this Resolution, at which time all persons interested were given an <br />opportunity to be heard. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa <br />Ana as follows: <br />Section 1. The City hereby adopts the "2019 Local Guidelines for <br />Implementing the California Environmental Quality Act," attached hereto and <br />incorporated herein as Attachment A, a copy of which is on file at the offices of the City <br />and is available for inspection by the public. <br />Section 2. It is the intent of the City to conform to the requirements of the <br />State CEQA Guidelines and CEQA. If any of the specific procedures or provisions <br />adopted herein should be in conflict with CEQA or the State CEQA Guidelines, then <br />CEQA and the State Guidelines shall prevail. The City may administer its <br />responsibilities under CEQA in any manner which meets the requirements of CEQA, <br />notwithstanding the specific procedures set forth in the City's Local CEQA Guidelines. <br />All future revisions to CEQA and the State CEQA Guidelines shall hereafter be <br />Resolution No. 2019-050 <br />Page 1 of 3 <br />
