Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) ACTIVITIES EXEMPT FROM CEQA <br /> <br />(Section B below), (2) affordable housing projects in urbanized areas (Section C below), or <br />(3) affordable housing projects near major transit stops (Section D below). <br />A. General Requirements. The construction, conversion, or use of residential <br />housing units affordable to low-income households (as defined in Local <br />Guidelines Section 11.36) located on an infill site in an urbanized area is exempt <br />from CEQA if all of the following general requirements are satisfied: <br />(1) The project is consistent with: <br />(a) Any applicable general plan, specific plan, or local coastal <br />program, including any mitigation measures required by such <br />plan or program, as that plan or program existed on the date that <br />the application was deemed complete; and <br />(b) Any applicable zoning ordinance, as that zoning ordinance <br />existed on the date that the application was deemed complete. <br />However, the project may be inconsistent with zoning if the <br />zoning is inconsistent with the general plan and the project site <br />has not been rezoned to conform to the general plan; <br />(2) Community level environmental review has been adopted or certified; <br />(3) The project and other projects approved prior to the approval of the <br />project can be adequately served by existing utilities, and the project <br />applicant has paid, or has committed to pay, all applicable in-lieu or <br />development fees; <br />(4) The project site meets all of the following four criteria relating to <br />biological resources: <br />(a) The project site does not contain wetlands; <br />(b) The project site does not have any value as a wildlife habitat; <br />(c) The project does not harm any species protected by the federal <br />Endangered Species Act of 1973, the Native Plant Protection <br />Act, or the California Endangered Species Act; and <br />(d) The project does not cause the destruction or removal of any <br />species protected by a local ordinance in effect at the time the <br />application for the project was deemed complete; <br />(5) The site is not included on any list of facilities and sites compiled <br />pursuant to Government Code Section 65962.5; <br />(6) The project site is subject to a preliminary endangerment assessment <br />prepared by a registered environmental assessor to determine the <br />existence of any release of a hazardous substance on the site and to <br />determine the potential for exposure of future occupants to significant <br />health hazards from any nearby property or activity.
