Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) ACTIVITIES EXEMPT FROM CEQA <br /> <br />(a) No cleanup action shall be subject to this Class 30 exemption if the action <br />requires the onsite use of a hazardous waste incinerator or thermal treatment unit <br />or the relocation of residences or businesses, or the action involves the potential <br />release into the air of volatile organic compounds as defined in Health and Safety <br />Code Section 25123.6, except for small scale in situ soil vapor extraction and <br />treatment systems which have been permitted by the local Air Pollution Control <br />District or Air Quality Management District. All actions must be consistent with <br />applicable state and local environmental permitting requirements including, but <br />not limited to, off-site disposal, air quality rules such as those governing volatile <br />organic compounds and water quality standards, and approved by the regulatory <br />body with jurisdiction over the site; <br />(b) Examples of such minor cleanup actions include but are not limited to: <br />1. Removal of sealed, non-leaking drums of hazardous waste or substances <br />that have been stabilized, containerized and are designated for a lawfully <br />permitted destination; <br />2. Maintenance or stabilization of berms, dikes, or surface impoundments; <br />3. Construction or maintenance or interim of temporary surface caps; <br />4. Onsite treatment of contaminated soils or sludge provided treatment <br />system meets Title 22 requirements and local air district requirements; <br />5. Excavation and/or offsite disposal of contaminated soils or sludge in <br />regulated units; <br />6. Application of dust suppressants or dust binders to surface soils; <br />7. Controls for surface water run-on and run-off that meets seismic safety <br />standards; <br />8. Pumping of leaking ponds into an enclosed container; <br />9. Construction of interim or emergency ground water treatment systems; or <br />10. Posting of warning signs and fencing for a hazardous waste or substance <br />site that meets legal requirements for protection of wildlife. <br />Class 31: Historical Resource Restoration/Rehabilitation. Maintenance, repairs, <br />stabilization, rehabilitation, restoration, preservation, conservation, or reconstruction of historical <br />of Historic Properties with Guidelines for Preserving, Rehabilitating, Restoring, and <br />Reconstructing Historic Buildings (1995), Weeks and Grimmer. (State CEQA Guidelines <br />Section 15331.) <br />Class 32: Infill Development Projects. Infill development meeting the following <br />conditions: <br />(a) The project is consistent with the applicable general plan designation and all <br />applicable general plan policies as well as with applicable zoning designation and <br />regulations; <br />(b) The proposed development occurs within city limits on a project site of no more <br />than five acres substantially surrounded by urban uses; <br />(c) The project site has no value as habitat for endangered, rare or threatened species; <br />(d) Approval of the project would not result in any significant effects relating to <br />traffic, noise, air quality, or water quality; and <br /> <br />2019 City of Santa Ana Local Guidelines 3-25 ©Best Best & Krieger LLP <br /> <br />
