'AUG-31-2000 11 : 05 AM A iRHORST RIvERSIDE CA 909 3630 P OS
LIABILITY INSURANCE
Adlerhorst recently made a decision to go without liability insurance for its
commercial operations. The city of Albuquerque, NM, along with the U.S.
Border Patrol, and the Arizona Department of Corrections have also agreed to
drop the liability insurance provision from their contract. Adlerhorst's
decision resulted from the following considerations:
1. The unavailability of insurance coverage for police service dog
trainers. Numerous, diligent efforts have been made to obtain
coverage, but all offers of coverage made so far are conditioned on
payment of premiums so exhorbitant as to be prohibitive of
Adlerhorst's continued existence.
2. The informed opinion of the owners and staff of Adlerhorst, that
their interests would be better served by retained counsel of their
own choice. Counsel who would respond solely to Adlerhorst's
interests, and not the overall business concerns (expenses, bad-faith
litigation, etc.) with which insurance companies must be concerned.
3. The lack of insurance defense counsel experienced in the area of
dogs, dog training, and specifically police dog training and
deployment.
Mr. E. Wallace Dingran, as staff counsel for Adlerhorst, is experienced in dog
training, and particularly police dog training; is certified to do police dog
agitation and decoy work; is a former prosecutor with extensive trial
experience; and, is an instructor in both the Adlerhorst new handler and
P.O.Sele re-certification courses. He is also available to Adlerhorst clients
for representation, and/or consultation services including investigation and
discovery proceedings.
4. The involvement cf staff counsel in the continuous review and
development of the training programs provided, and the fact that the
deg selection process, certification standards, and training employed
are of such a high degree, that liability exposure to third persons
who may be injured by the police service dogs, is negligible.
5. The desire to be a responsible force in litigation of police dog
related issues; and to litigate meritless claims rather than settle
them, even for a nominal value, to prevent the creation of tacit
precedents which encourage specious lawsuits.
Adlerhorst appreciates the concern the lack of liability insurance may cause,
and they sincerely hope that their reputation, and the high level of training
and superior support services provided will convince you to use Adlerhorst's
services.
