EXHIBIT 3 <br />LS 7.16.19 <br />RESOLUTION NO.2019-xx <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA APPROVING <br />APPEAL APPLICATION NO. 2019-02 AND <br />REVERSING THE DETERMINATION OF THE <br />PLANNING COMMISSION TO ADD TWO <br />ADDITIONAL CONDITIONS FOR CONDITIONAL <br />USE PERMIT (CUP) NO. 2019-12 FOR THE 24 <br />HOUR OPERATION OF THE 7 ELEVEN <br />CONVENIENCE STORE TO BE LOCATED AT <br />1904 WEST FIRST STREET <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. On May 13, 2019 and June 10, 2019, the Planning Commission held a <br />public hearing as required by law on Conditional Use Permit (CUP) No. <br />2019-12 to allow a proposed 7-Eleven convenience store to operate 24 <br />hours a day at 1904 West First Street. After listening to public testimony <br />and consideration of the facts, the Planning Commission conditionally <br />approved CUP No. 2019-12 by a vote of 7:0 and added the following two <br />conditions of approval which are intended to further preserve the health, <br />safety and general welfare of the surrounding community: <br />There shall be an on -site security guard from 6:00 a.m. to 10:00 <br />p.m. and the Santa Ana Police Department shall review police <br />activity for the site on a semi-annual basis to determine if the hours <br />for security shall be reduced or expanded, and <br />The Franchisee shall be an active member of the Cosa Bonita <br />Neighborhood Association. <br />B. On June 20, 2019, the applicant submitted a timely appeal to the City <br />requesting that the City Council reconsider the added conditions of <br />approval by the Planning Commission. <br />C. On July 16, 2019, the City Council conducted a duly noticed de novo <br />public hearing on Appeal Application No. 2019-02. <br />D. The City Council of the City of Santa Ana has considered the information <br />and determines that the following findings, which must be established in <br />Resolution No. 2019-xx <br />Page 1 of 10 <br />75B-19 <br />
