D. At its regular City Council meeting on June 4, 2019, the City Council by a vote <br />of 6:0 continued the public hearing for Zoning Ordinance Amendment (ZOA) <br />No. 2019-03 for 30 days. <br />E. The City Council, on July 2, 2019, held a duly noticed public hearing on this <br />zoning ordinance and amendments, and has considered all testimony <br />presented thereto. <br />Section 2. The proposed ordinance has been reviewed with respect to <br />applicability of the California Environmental Quality Act ("CEQA") and the State CEQA <br />Guidelines (California Code of Regulations, Title 14, Section 15000 etseq.). The project <br />is exempt from CEQA as it can be seen with certainty that there is no impact on the <br />environment (Section 15061(b) (3)] and a Notice of Exemption will be filed upon <br />adoption of this ordinance. <br />Section 3, Sections 41-2009, 41-2010, 41-2011, 41.2012, 41-2013, 41-2014, <br />41-2015, 41-2020, 41.2021, 41-2022, 41-2023, 41-2024, 41-2025, 41-2026, 41-2027, <br />41-2028, 41.2029, 41-2030, 41-2031, and 41-2032 of the Santa Ana Municipal Code in <br />the Transit Zoning Code/Specific Development (SD) No. 84 zoning district are hereby <br />amended and attached hereto as Exhibit A and incorporated by reference as though <br />fully set forth herein. <br />Section 4, If any section, subsection, sentence, clause, phrase or portion of <br />this ordinance for any reason held to be invalid or unconstitutional by the decision of <br />any court of competent jurisdiction, such decision shall not affect the validity of the <br />remaining portions of this ordinance. The City Council of the City of Santa Ana hereby <br />declares that it would have adopted this ordinance and each section, subsection, <br />sentence, clause phrase or portion thereof irrespective of the fact that any one or more <br />sections, subsections, sentences, clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br />ADOPTED this day of 2019. <br />APPROVED AS TO FORM: <br />Sonia R.
