75B.PUBLIC HEARING - APPEAL APPLICATION NO. 2019-02 FILED BY FIEDLER GROUP ON <br />BEHALF OF 7-ELEVEN INC. <br />It is respectfully requested that City Council support the Staff Recommended Action to DENY <br />the Appeal <br />[see pictures below, this area has a long history of loitering and illicit activity; this project will invite more loitering <br />and/or become a gathering place for such activity] <br />FACTS: <br />• This project is proposed some 50 feet from single family homes <br />• This area has a long-term history of loitering, drug sales and illicit activity <br />o (its adjacent to the former OC Rescue Mission site on Walnut St) <br />• Project is adjacent to OC General Relief (Social Services) <br />o a place known for significant loitering, many of whom are homeless <br />• Many residents walk past the location of the proposed project: to and from: school, supermarket, laundry, bus <br />stop, etc <br />• Residents spoke out in opposition of the proposed 7-eleven (see one sample email below sent to Planning <br />Commission) <br />PLANNING COMMISSION: <br />In spite of opposition, Planning Commission voted to support the approval of the 7-eleven project to support <br />reuse of this parcel and economic development <br />Planning Commission added two reasonable conditions to mitigate concerns and ensure 7-eleven is a good new <br />neighbor <br />o Part-time security guard (not 24 hours) to avoid loitering, illicit activities and to make it a safe place for <br />the neighbors <br />o Participation with local Neighborhood Association to have open lines of communication with neighbors <br />Note: Applicant's response to providing security measures: <br />• a silent alarm for employees to contact SAPD (in essence security to be paid by local tax payers) <br />• suggested that neighbors deal with safety impacts and placed the burden on residents to have to petition for <br />added safety measures after the fact <br />An additional concern has been presented regarding the size of the gas tanker delivery truck. Given the tight location <br />adjacent to both a busy street and residential neighborhood.
