I C1
BEST BEST & KRIEGER
ATTORNEYS AT LAW
MEMORANDUM
To:
PUBLIC AGENCY CLIENTS
From:
BEST BEST & KRIEGER LLP
Date:
NOVEMBER 12, 2018
Re:
AB 2257 AND NEW BROWN ACT POSTING REQUIREMENTS
Analysis of AB 2257
AB 2257 was enacted in 2016 and amended the Ralph M. Brown Act, specifically
Government Code section 54954.2, with new requirements related to meeting agenda
postings on local agency websites. The statute imposed additional requirements
regarding the location, platform, and methods by which an agenda must be accessible
on the agency's website for all meetings occurring on or after January 1, 2019. The
statute provides two options for compliance.
First, an agency that has a website must post a direct link to the current agenda
on its primary homepage, not in a "contextual menu," such as a drop -down tab, that
would require a user to perform an action to reveal the agenda link. The agenda must
be (a) downloadable, indexable, and electronically searchable by common internet
browsers; (b) platform independent and machine readable; and, (c) available to the
public, free of charge and without restrictions that interfere with its reuse or
redistribution.
Second, an agency may implement an "integrated agenda management
platform," meaning a dedicated webpage that provides the necessary agenda
information. The platform may contain prior agendas but the most current agenda must
be located at the top of the page. Under this option, a direct link to the current agenda
does not need to be posted on the homepage but the agency is required to post a link to
the platform containing the agenda information. The link, however, may not be hidden in
a contextual menu. The same criteria regarding agenda retrieval, searching, and
readability that apply to the first option also apply to this second option.
These additional requirements apply only if your agency maintains a website. A
local agency is not required to create or otherwise maintain a website if it does not
already have one.
If you have any questions regarding this memo, please contact your Best Best &
Krieger counsel or one of the authors.
ALBERT MALDONADO
GARY W.SCHONS
93939.00002\31606380.1
