LS 5.28.19 <br />RESOLUTION NO. 2019-23 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA APPROVING CONDITIONAL <br />USE PERMIT NO. 2019-14 AS CONDITIONED TO <br />ALLOW AFTER HOURS OPERATION FOR AN IN-N-OUT <br />BURGER RESTAURANT LOCATED AT 815, 827, 829, <br />AND 907 NORTH BRISTOL STREET <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Katie Sanchez, with In-N-Out ("Applicant'), is requesting approval of <br />Conditional Use Permit No. 2019-14 to allow after-hours operation for a new <br />restaurant located at 815, 827, 829, and 907 North Bristol Street. <br />B. Santa Ana Municipal Code ("SAMC") Section 41-424.50) requires <br />approval of a conditional use permit for eating establishments who intend <br />to operate between 12:00 a.m. and 5:00 a.m. and are located within 150 <br />feet of a residential property or residential use. Specifically, the subject In- <br />N-Out Burger location is proposing to remain open until 1:00 a.m. Sunday <br />through Thursday, and until 1:30 a.m. on Friday and Saturday. <br />C. Pursuant to SAMC Section 41-638, the Planning Commission is <br />authorized to review and approve the conditional use permit for this <br />project as set forth by the Santa Ana Municipal Code. <br />D. On May 13, 2019, the Planning Commission held a duly noticed public <br />hearing for Conditional Use Permit No. 2019-14. At the request of staff, <br />the item was continued to the May 28, 2019 Planning Commission <br />meeting. <br />E. On May 28, 2019, the Planning Commission held a duly noticed public <br />hearing for Conditional Use Permit No. 2019-14. <br />F. The Planning Commission of the City of Santa Ana has considered the <br />information and determines that the following findings, which must be <br />established in order to grant Conditional Use Permit No. 2019-14 for after- <br />hours operation, have been established as required by SAMC Section 41- <br />638: <br />1.
