ARTICLE I <br />1.0 RECOGNITION <br />1.1 Pursuant to the provisions of the Meyers-Milias-Brown Act, Government Code <br />Section 3500, et sea., the City of Santa Ana (hereinafter called "the City") has <br />recognized the Confidential Association of Santa Ana (hereinafter called <br />"CASA") as the majority representative of the bargaining unit which includes <br />all full-time and designated Part -Time Civil Services (PTCS) employees <br />employed by the City of Santa Ana in classifications heretofore designated <br />as "confidential' and which are listed in Exhibit A of this Memorandum of <br />Understanding ("MOU"). <br />1.2 Notwithstanding the following provisions of this MOU, the parties agree that <br />they have intended nothing herein to entitle, alter or award Civil Service <br />rights or privileges to any employee represented by CASA who is in the <br />Excepted (Exempt) Service of the City of Santa Ana. <br />1.3 During the term of this MOU, no substantive issue of representation shall be <br />raised contrary to this MOU except as provided in this MOU or in Resolution <br />No. 81-75, the Employer -Employee Relations Resolution of the City of Santa <br />Ana (refer to Exhibit B). <br />1.4 The term "employee" or "employees" as used herein shall refer only to full- <br />time and designated Part -Time Civil Service CASA employees of the City, in <br />the employee classifications listed in Exhibit A of this MOU, as well as such <br />classifications as may be added hereinafter by resolution of the City Council. <br />1.5 It is the purpose of this MOU to promote and provide for harmonious relations, <br />cooperation and understanding between the City and employees covered <br />by this MOU. It sets forth the full and entire understanding reached in good <br />faith negotiations regarding the wages, hours, terms and conditions of <br />employment of employees covered by this MOU, which the parties intend to <br />submit jointly and recommend for approval to the City Council of the City of <br />Santa Ana. <br />1.6 Employees with classifications designated as Part -Time Civil Service (PTCS) <br />within this Bargaining Unit are covered under all sections of this MOU.
