7.4 All FLSA nonexempt employees working under the "9/80" work schedule shall <br />earn overtime for all hours worked after the first forty (40) hours in a FLSA work <br />week as required under FLSA. Should the City modify the manner by which it <br />pays overtime (FLSA) to members of other miscellaneous bargaining units, <br />CASA agrees to reopen this topic for discussion. <br />7.5 Compensation for Overtime. <br />A. The preferable method by which overtime shall be compensated is by <br />monetary payment, at one and one-half (1.5) times the employee's <br />regular rate of pay, subject to the provisions of Subsection C below. <br />B. Should the Department Head determine that the best interests of the <br />City will be served thereby, he or his designee may permit an <br />employee to be compensated for overtime work by taking paid <br />compensatory time off in lieu of monetary compensation. <br />C. Employees shall have the option with Department Head approval to <br />convert a maximum of eighty (80) hours of time and one-half paid <br />overtime (in compensation for 53 1/3 [fifty-three and one-third] <br />overtime hours worked) to time and one-half compensatory time off <br />benefits. Such compensatory time off shall be taken at the discretion <br />of the employee when requested at least 72 hours in advance, <br />provided it does not unduly disrupt the operations of the agency. If <br />the Department Head or his or her designee subsequently denies the <br />requested compensatory time off, the employee and department <br />shall mutually agree on a future date within one year when the <br />employee can use the paid compensatory time off. If the requested <br />compensatory time off is not used within that one year, such <br />compensatory overtime will be paid off in cash. <br />D. The compensatory time bank for employees covered by this MOU has <br />a maximum accrual limit of one hundred and sixty (160) hours. <br />E. Because each hour of overtime worked is accrued on a time and one- <br />half basis, compensatory time off shall be taken, and monetary <br />payment shall be paid, on a straight -time basis. Also, upon <br />termination, any earned, unused compensatory time off ("time -on -the - <br />books") shall be paid on a straight -time basis. <br />Time off with pay to compensate for overtime worked may be taken in <br />increments as small as a half ('/2) hour. <br />CONFIDENTIAL ASSOCIATION OF SANTA ANA ICASA) MOU: JANUARY 1, 2019 THROUGH JUNE 30, 2022 <br />Page 26 <br />55C-36 <br />
