As part of the recommended action, the City Council will take separate <br />actions on the following: (1) Resolution approving and adopting Addendum <br />to the Environmental Impact Report for the Fashion Square Commercial <br />Center Project (SCH No. 1983021103) and Mitigation Monitoring and <br />Reporting Program, attached and included herein as Attachment A; (2) <br />Ordinance for Amendment Application No. 2018-04, attached and included <br />herein as Attachment B; (3) Ordinance for Development Agreement No. <br />2018-02, attached and included herein as Attachment C; and (4) <br />Resolution for Tentative Parcel Map No. 2018-01 as conditioned, attached <br />and included herein as Attachment D. <br />Section 2. The Planning Commission has independently reviewed and <br />analyzed the draft Addendum to the Environmental Impact Report for the Fashion Square <br />Commercial Center Project (SCH No. 1983021103) and Mitigation Monitoring and <br />Reporting Program. The Addendum and Mitigation Monitoring and Reporting Program <br />are included as Attachment A to the Request for Planning Commission Action dated <br />May 13, 2019 for the project. Pursuant to CEQA Guidelines Section 15074(a), the <br />Planning Commission considered the analysis and conclusion of the MND as well as <br />the mitigations outlined in the Mitigation Monitoring and Reporting Program. The <br />Planning Commission recommends, as a result of its consideration and the evidence <br />presented at the hearings on this matter, that the City Council determine that, as <br />required pursuant to the California Environmental Quality Act (CEQA) and the State <br />CEQA Guidelines, the MND adequately addresses the expected environmental impacts <br />of this project. On the basis of this review, the Planning Commission recommends that <br />the City Council find that there is no substantial evidence from which it can be fairly <br />argued that the project will have a significant adverse effect on the environment and the <br />MND reflects the independent judgment and analysis of the City Council. <br /> Section 3. This Planning Commission of the City of Santa Ana after <br />conducting the public hearing hereby recommends that the City Council adopts the <br />Addendum to the Environmental Impact Report for the Fashion Square Commercial <br />Center Project (SCH No. 1983021103) and re-adopts the Mitigation Monitoring and <br />Reporting Program, consistent with Public Resources Code section 21081.6; make <br />implementation of the Mitigation Measures contained in the Mitigation Monitoring and <br />Reporting Program a condition of approval of the Project; adopt the Mitigation <br />Monitoring and Reporting Program; and direct that the Notice of Determination be <br />prepared and filed with the County Clerk of the County of Orange in the manner <br />required by law; adopt an ordinance approving Amendment Application No. 2018-04; <br />recommends that the City Council adopt an ordinance approving Development <br />Agreement No. 2018-02; and recommends that the City Council adopt a resolution <br />approving Tentative Parcel Map No. 2018-01 as conditioned to facilitate construction of <br />the subject development. <br />Section 4.
