Planning Commission Agenda 3 May 28, 2019 <br /> <br />BUSINESS CALENDAR <br />Persons wishing to speak regarding Business Calendar matters should file a "Request to Speak" form with the Recording <br />Secretary. Members of the public will be allotted 3 minutes to speak, unless additional time is granted by the Chairperson. <br /> <br /> <br /> <br /> <br /> <br /> <br />PUBLIC HEARINGS <br /> <br />1. AMENDMENT APPLICATION NO. 2019-02; CONDITIONAL USE PERMIT NO. 2019- <br />12; VARIANCE NO. 2019-01 {STRATEGIC PLAN NO. 5, 4} – Jerry Guevara, Case <br />Planner. <br /> <br />REQUEST: Filed by Fiedler Group, representing 7-Eleven, Inc. to: (1) change the <br />zoning designation from Light Industrial (M-1) to General Commercial (C-2); (2) allow <br />after-hours operation: and (3) allow an additional free -standing sign for a new <br />convenience store/gas station (7-Eleven) located at 1904 W. First Street. <br /> <br />ENVIRONMENTAL DETERMINATION: In accordance with the California Quality <br />Environmental Act (CEQA), a Mitigated Negative Declaration (MND), Environmental <br />Review No. 2017-140 was prepared for the project. The MND concluded that the <br />project would have a less than significant environmental impact with implementation of <br />mitigation measures. Mitigation measures are included to address biological <br />resources, geology and soils, noise, transportation, hazards, and hazardous materials. <br /> <br />RECOMMENDED ACTION: Continue the matter until June 10, 2019. <br /> <br />General Notes: Legal notice published in the Orange County Reporter on May 3, 2019 <br />and notices mailed on May 2, 2019. Matter was continued from the May 13, 2019 <br />meeting by a vote of 6:0 (Alderete absent). Staff has requested the matter be <br />continued. <br /> <br /> <br />2. CONDITIONAL USE PERMIT NO. 2019-13; CONDITIONAL USE PERMIT NO. 2019- <br />14; AND CONDITIONAL USE PERMIT NO. 2019-17 {STRATEGIC PLAN NO. 5, 4} – <br />Ivan Orozco, Case Planner. <br /> <br />REQUEST: Filed by In-N-Out Burger to allow: (1) drive-through window service; (2) <br />after-hours operation; and (3) walk-up window service for a new restaurant (In-N-Out <br />Burger) located at 815 and 827, 829, and 907 North Bristol Street in the Bristol Street <br />Corridor Specific Plan (SP-1) zone. <br /> <br />ENVIRONMENTAL DETERMINATION: In accordance with the California Quality <br />Environmental Act (CEQA), the proposed project is exempt from further review <br />pursuant CEQA Guidelines Section 15302, Class 2, Replacement or Reconstruction. <br />This exemption applies if the new structure will be located on the same site as the <br />structure replaced and will have substantially the same purpose and capacity as the <br />structure replaced. Categorical Exemption ER No. 2018 -43 will be filed for this project. <br /> <br />RECOMMENDED ACTION: Adopt the following resolutions. <br />
