Resolution No. 2019-xx <br />Page 1 of 2 <br /> <br /> <br /> LS 5.28.19 <br />RESOLUTION NO. 2019-xx <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA RECOMMENDING THAT <br />THE CITY COUNCIL ADOPT LOCAL CEQA <br />GUIDELINES FOR IMPLEMENTING THE CALIFORNIA <br />ENVIRONMENTAL QUALITY ACT (PUBLIC <br />RESOURCES CODE §§ 21000 ET SEQ.) <br />WHEREAS, the California Legislature has amended the California Environmental <br />Quality Act (“CEQA”) (Pub. Resources Code §§ 21000 et seq.), the Natural Resources <br />Agency has amended the State CEQA Guidelines (Cal. Code Regs, Title 14, §§ 15000 et <br />seq.), and the California courts have interpreted specific provisions of CEQA; and <br /> <br />WHEREAS, Public Resources section 21082 requires all public agencies to adopt <br />objectives, criteria and procedures for (1) the evaluation of public and private projects <br />undertaken or approved by such public agencies, and (2) the preparation, if required, of <br />environmental impact reports and negative declarations in connection with that evaluation; <br />and <br /> <br />WHEREAS, the City of Santa Ana has prepared local guidelines for implementing <br />CEQA consistent with the current provisions and interpretations of CEQA and the State <br />CEQA Guidelines; and <br /> <br />WHEREAS, on May 28, 2019, the Planning Commission held a duly noticed public <br />hearing to consider this Resolution, at which time all persons interested were given an <br />opportunity to be heard. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of <br />Santa Ana: <br />Section 1. Recommends that the City Council adopt the “2019 Local Guidelines for <br />Implementing the California Environmental Quality Act,” attached hereto as Exhibit 1, a copy <br />of which is on file at the offices of the City and is available for inspection by the public. <br />Section 2. It is the intent of the City to conform to the requirements of the State <br />CEQA Guidelines and CEQA. If any of the specific procedures or provisions adopted herein <br />should be in conflict with CEQA or the State CEQA Guidelines, then CEQA and the State <br />Guidelines shall prevail. The City may administer its responsibilities under CEQA in any <br />manner which meets the requirements of CEQA, notwithstanding the specific procedures set <br />forth in the City’s Local CEQA Guidelines. All future revisions to CEQA and the State CEQA <br />Guidelines shall hereafter be considered to be part of the City’s implementing procedures <br />without further action by the City Council. <br /> <br />EXHIBIT 1
