Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) NEGATIVE DECLARATION <br /> <br /> <br />2019 City of Santa Ana Local Guidelines 6-18 ©Best Best & Krieger LLP <br />If the City believes that a project for which it is Lead Agency will have “no effect” on fish <br />or wildlife resources, it should contact the appropriate DFW Regional Office. The project’s CEQA <br />document may need to be provided to the appropriate DFW Regional Office along with a written <br />request. Documentation submitted to the appropriate DFW Regional Office should set forth facts <br />in support of the fee exemption. Previous examples of projects that have qualified for a fee <br />exemption include: minor zoning changes that did not lead to or allow new construction, grading, <br />or other physical alterations to the environment; and minor modifications to existing structures, <br />including addition of a second story to single or multi-family residences. <br />The fee exemption requirement that the project have “no” impact on fish or wildlife <br />resources is more stringent than the former requirement that a project have only “de minimis” <br />effects on fish or wildlife resources. DFW may determine that a project would have no effect on <br />fish and wildlife if all of the following conditions apply: <br />• The project would not result in or have the potential to result in harm, harassment, <br />or take of any fish and/or wildlife species. <br />• The project would not result in or have the potential to result in direct or indirect <br />destruction, ground disturbance, or other modification of any habitat that may support fish and/or <br />wildlife species. <br />• The project would not result in or have the potential to result in the removal of <br />vegetation with potential to support wildlife. <br />• The project would not result in or have the potential to result in noise, vibration, <br />dust, light, pollution, or an alteration in water quality that may affect fish and/or wildlife directly <br />or from a distance. <br />• The project would not result in or have the potential to result in any interference <br />with the movement of any fish and/or wildlife species. <br />Any request for a fee exemption should include the following information: <br />(1) the name and address of the project proponent and applicant contact information; <br />(2) a brief description of the project and its location; <br />(3) site description and aerial and/or topographic map of the project site; <br />(4) State Clearinghouse number or county filing number; <br />(5) a statement that an Initial Study has been prepared by the City to evaluate the <br />project’s effects on fish and wildlife resources, if any; and <br />(6) a declaration that, based on the City’s evaluation of potential adverse effects on fish <br />and wildlife resources, the City believes the project will have no effect on fish or <br />wildlife. <br />3 -95
