If the Governor certifies the project, the <br />lead agency must make the administrative record available concurrently with the Draft EIR and <br />certify the administrative record within five (5) days of project approval and must make it available <br />in an electronic format. Within 10 days of the Governor certifying an Environmental Leadership <br />Development Project, the Lead Agency shall, at the applicant’s expense, issue a public notice. See <br />Public Resources Code Section 21187 for the language to be used in the public notice. If litigation <br />is filed against such a project, certain fast-tracked litigation procedures will apply. Please see <br />Public Resources Code Section 21178 and Sections 21183 through 21187 for a complete <br />description of the requirements for such projects. <br />7.06 PREPARATION OF DRAFT EIR. <br />The Lead Agency is responsible for preparing a Draft EIR. The Lead Agency may begin <br />preparation of the Draft EIR without awaiting responses to the Notice of Preparation. However, <br />information communicated to the Lead Agency not later than thirty (30) days after receipt of the <br />Notice of Preparation shall be included in the Draft EIR. <br />7.07 CONSULTATION WITH CALIFORNIA NATIVE AMERICAN TRIBES. <br />Prior to the release of a Draft EIR for a project, the Lead Agency shall begin consultation <br />with a California Native American tribe that is traditionally and culturally affiliated with the <br />geographic area of the proposed project if: <br />(a) The California Native American tribe requested to the Lead Agency, in writing, to <br />be informed by the Lead Agency through formal notification of proposed projects <br />in the geographic area that is traditionally and culturally affiliated with the tribe; <br />and <br /> <br />(b) The California Native American tribe responds, in writing, within 30 days of receipt <br />of the formal notification, and requests the consultation. The California Native <br />American tribe shall designate a lead contact person when responding to the Lead <br />Agency. If a lead contact is not designated by the California Native American tribe, <br />or if it designates multiple lead contact people, the Lead Agency shall defer to the <br />individuals listed on the contact list maintained by the Native American Heritage <br />Commission. Consultation is defined in Local Guidelines Section 11.12. <br /> <br />To expedite the requirements of this section, the Native American Heritage Commission <br />shall assist the Lead Agency in identifying the California American Native tribes that are <br />traditionally and culturally affiliated with the project area. <br /> <br />Within 14 days of determining that an application for a project is complete or a decision <br />by a public agency to undertake a project, the Lead Agency shall provide formal notification to <br />the designated contact of, or a trial representative of, traditionally and culturally affiliated <br />California Native America tribes that have requested notice, which shall be accomplished by at <br />least one written notification that includes a brief description of the proposed project and its <br />location, the Lead Agency contact information, and a notification that the California Native <br />American tribe has 30 days to request consultation. <br />3 -100
