Local Guidelines for Implementing the <br />California Environmental Quality Act (2019) TYPES OF EIRS <br /> <br /> <br />2019 City of Santa Ana Local Guidelines 8-2 ©Best Best & Krieger LLP <br />(c) Infill Projects and Tiering. <br /> <br />Certain “infill” projects may tier off of a previously certified EIR. An “infill” project is <br />defined as a project with residential, retail, and/or commercial uses, a transit station, a school, or a <br />public office building. It must be located in an urban area on a previously developed site or on an <br />undeveloped site that is surrounded by developed uses. The project must be either consistent with <br />land use planning strategies that achieve greenhouse gas (“GHG”) emission reduction targets, <br />feature a small walkable community project, or where a sustainable communities or alternative <br />planning strategy has not yet been adopted for the area, include a residential density of at least 20 <br />units per acre or a floor area ratio of at least 0.75. The project must also meet a number of standards <br />related to energy efficiency that are not yet defined but which SB 226 directs the Office of Planning <br />and Research to prepare. <br /> <br />If an EIR was certified for a planning level decision by a city or county (such as a General <br />Plan or Specific Plan), the scope of the CEQA review for a later “infill” project can be limited to <br />those effects on the environment that: 1) are specific to the project or to the project site and were <br />not addressed as significant effects in the prior EIR; or 2) substantial new information shows will <br />be more significant than described in the prior EIR. <br />When a project meets the definition of “infill” and either of the above conditions exist but <br />a Mitigated Negative Declaration cannot be adopted, then the subsequent EIR for such a project <br />need not consider alternative locations, densities, and building intensities or growth-inducing <br />impacts. <br />(d) Statement of Overriding Considerations. <br /> <br />A Lead Agency may also tier off of a previously prepared Statement of Overriding <br />Considerations if certain conditions are met. (See Local Guidelines Section 7.37.) <br />8.03 PROJECT EIR. <br />The most common type of EIR examines the environmental impacts of a specific <br />development project and focuses primarily on the changes in the environment that would result <br />from the development project. <br />If the EIR for a redevelopment plan is a Project EIR, all public and private activities or <br />undertakings pursuant to or in furtherance of the Redevelopment Plan shall constitute a single <br />project, which shall be deemed approved at the time of the adoption of the Redevelopment Plan. <br />Although the City will probably not act as a Lead Agency for a Redevelopment Plan, the City may <br />act as a Responsible Agency. (State Guideline Section 15180.) <br />8.04 SUBSEQUENT EIR. <br />A Subsequent EIR is required when a previous EIR has been prepared and certified, or a <br />Negative Declaration or Mitigated Negative Declaration has been adopted, for a project and at <br />least one of the three following situations occur: <br />3 -133
